About this file

This is a Fines and Penalties Chart document approved by the City of New Haven Board of Aldermen for fiscal year 2024-2025, outlining compliance violations and associated penalties administered by the Commission on Equal Opportunities. The document establishes enforcement penalties for construction contractors and subcontractors working on city projects related to wage certification, reporting requirements, and diversity participation goals. Key violations include failure to attend mandatory pre-award conferences ($3,000 per violation or 2% of construction contract amount, whichever is greater), late certified or living wage weekly payroll reports ($1,000 per week or 1% of contract amount per week, whichever is greater), and missing or incorrectly filled daily employee reports ($750 per violation). The penalties escalate for repeated or egregious violations, with charges assessed against responsible contractors at all tiers up to and including the general contractor.

The chart also establishes penalties for violations of diversity participation goals, including failure to meet maximum effort requirements for minority participation, female participation, and resident participation (when applicable) at $2,000 per week or 1% of the respective construction contract amount, whichever is greater, charged for each week of violation throughout the project work period. Additional penalties apply for repeated violations of reporting requirements at the same project site, with penalties charged separately to affected contractors at all contracting tiers. These enforcement mechanisms are referenced under City General Statutes Section 17-201(15) and apply to all construction contracts subject to the city's wage certification and equal opportunity compliance requirements.
