About this file
This document is a Justification and Approval (J&A) for a sole source contract award by the Naval Air Systems Command (NAVAIR) to the Ministry of Defence, Defence Equipment Sales Authority (DESA) for Center Wing Box (CWB) top kits and a shipping fixture for a C-130J aircraft.
The J&A states that DESA is the only known source that can meet the required delivery date for the CWB parts, as constructing new parts from the manufacturer would take 27 months and miss the schedule requirements, causing the cancellation of an entire Blue Angels air show season. Market research and a Sources Sought notice confirmed that no other sources exist that can satisfy NAVAIR's requirements. NAVAIR awarded a sole source contract to DESA valued at $9,139,900 on September 17, 2024 under the authority of FAR 6.302-1. The Contracting Officer determined the price to be fair and reasonable. NAVAIR does not currently plan to compete future requirements, but will assess feasibility if another potential source emerges.

Text version
avoid a gap in logistics support aircraft for the Blue Angels. The MoD is the only known source with ESL CWB parts that will meet the required delivery date. Construction of a new ESL CWB from the manufacturer has a lead time of 27 months and will not meet the schedule requirements. Such delays would result in the cancellation of an entire season of air show performances by the Blue Angels due to lack of a suitable logistics support aircraft.
Therefore, the MoD is the only source that can provide an ESL CWB to meet NAVAIR’s requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted to determine if any sources other than MoD exist that can satisfy the agency's requirements. This effort included discussions with subject matter experts within the United States Government (USG) as well as industry. A Sources Sought notice was published via the System for Award Management (SAM.gov) website on 31 Jul 2023. No responses were received. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than MoD to provide the required supplies and services. The proposed contract was synopsized for informational purposed on 28 Aug 2023. The posting closed on 8 Sep 2023 with no responses from industry received.
Additionally, any parties interested in subcontracting opportunities will be referred to MoD to maximize competition in subcontracted efforts.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the USG of the supplies covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVAIR has no plans at this time to compete future contracts for the requirements covered in this document. If another potential source emerges, NAVAIR will determine whether competition for future requirements is feasible.
