About this file
This document is a justification and approval for other than full and open competition. It details a ceiling increase modification to an existing Navy contract with Raytheon Technologies to provide continued systems engineering, development, testing, integration and fielding support for the Cooperative Engagement Capability program from Q3 FY2023 through Q3 FY2024. Raytheon Technologies is currently the only company with the technical expertise and experience required to deliver an integrated CEC system and meet the fleet's software baseline schedule without unacceptable delays, as a new contractor would require a minimum of an 18-month learning curve. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as Raytheon Technologies is the only responsible source capable of fulfilling the Navy's needs within the required timeframe.

4. Statutory Authority Permitting Other Than Full and Open Competition
In accordance with 10 U.S.C. 3204(a)(1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Pursuant to 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1(a)(2)(ii), Raytheon Technologies is the only responsible source capable of providing the required systems engineering, system development, test, integration, and fielding of critical CEC capability improvements without causing unacceptable delays in fulfilling the Navy’s requirements during this period of performance from Third Quarter (3Q) FY2023 to 3QFY2024. This determination is informed by the evaluated risks and the below assessment regarding the initial learning curve.
Raytheon Technologies was the sole offeror for the competitively solicited N00024-19-C-5200 DA/ES contract.
While it has been determined by the program office and its associated Government Subject Matter Experts (SMEs) that the initial design/development of segments of CEC Increment 2 functionality will be competed via Other Transaction Authority (OTA), Raytheon Technologies is currently the only company that has resources with the technical knowledge, insight, and tenured experience to support the comprehensive system-level CEC maturation and system integration activities required to deliver the fully integrated CEC system for testing, certification and fielding without unacceptable delays to the Fleet-approved software (SW) baseline delivery schedule.
