Questions and Answers for Data Center Circuits Solicitation No. CB18-RFQ0006

May 24, 2018

Technical Questions

Question 1: It is stated the you are looking for multiple vendors to satisfy your requirements of

“diversity” to the fiber paths. To what extent? Are you looking for one vendor to supply “Path (1)” and another vendor “Path (2)” – or could one vendor supply both?

Answer: We are looking at both options – either one vendor for both, or different vendors for each path. Diversity means the fiber paths are separate for local loop, intermediate distance, and the backbone.

Question 2: Are you looking for “dual” entrances into all sites for the point-to-point connections? Or could just one entrance be utilized at any or all sites?

Answer: We are looking for dual entrances into all sites.

Question 3: You mention that “construction” is not allowed to any site – can this stipulation be eliminated / modified?

Answer: CBO cannot approve any construction as it will require additional approval from third parties. However, the provider can obtain all the necessary approvals of construction independently provided they can still meet CBO’s timetable.

Question 4: We were told in the past that there was existing conduit (dual entrances) that were available for our use into the Alternate Computing Facility (ACF). Is this still viable?

Answer: Yes, the conduit should be still available.

Question 5: If so that [existing conduit] would involve only a fiber pull into the building (no real construction on private property). Is that acceptable?

Answer: Yes, that is acceptable.

Question 6: It is stated the timeline for install once a vendor is selected is 45 days – can this be extended as normal install timelines for these types of services are 90-120 days given equipment install, fiber splicing, testing, etc.

Answer: 45 days is our ideal requirement, but CBO will consider longer options such as 90-120 days as well.

Question 7: Will the Government please identify the exact demarcation point for handoff at each location?

Answer: See Appendix A – Location of CBO Datacenter Facilities of the RFQ. The central office prefix (exchange) for each location has been added by Amendment No. 001.

Question 8: Will the Government provide rack space and power for termination equipment at each location?

Answer: Yes.

Questions and Answers for Solicitation No. CB18-RFQ0006 Page 2 Data Center Circuits

Question 9: Will the Government make provisions for a site visit at each location prior to the RFP submission date?

Answer: Yes, site visits will need to be scheduled in advance by contacting guanli.lu@cbo.gov. We are coordinating with both locations, the ACF and ByteGrid, to schedule a specific day to visit. Additional information will be provided to offerors when they submit a request for a site visit.

Question 10: What is the penalty to the selected Carrier if delivery of new circuits is greater than 45 days after contract award?

Answer: See answer to Question 6.

Question 11: Requirement C1 lists 2 x 1 Gbps Point to point circuits between ACF to ByteGrid and requirement C2 describes 2 x 1 Gbps point to point circuits between FHOB and Bytegrid. These circuits must have “route redundancy and diversity” as stated in the Scope of Work.

- Is each vendor providing two separate 2 x 1 Gbps circuits or will they just provide one 1 Gbps circuit and the route redundancy and diversity requirement be satisfied via multiple vendors?

- If each vendor is providing 2 x 1 Gbps circuits, what level of diversity do you require for the circuits?

Answer: See answer to Question 1. CBO is open to one provider or multiple providers as long as path diversity is guaranteed.

Question 12: Will each circuit need Equipment, entrance, fiber path and PoP diversity from each other or will the diversity requirement be satisfied via multiple vendors?

Answer: As long as the true path diversity requirement is met, CBO will consider either single vendor or multiple vendors.

Question 13: Ref. Statement of Work, Section 2, Paragraph 3 – “Internet requirement is for new circuits at ACF & FHOB”. Is this correct or should this requirement read

“ACF & BYTEGRID”?

Answer: Correct. See the revision in Amendment No. 001 to change the sentence to “ACF and ByteGrid”.

Question 14: Will CBO provide the CPE for the private point-to-point circuits or does CBO expect the provider to supply them?

Answer: CBO will provide internet routers (Cisco ASR 1001x) for internet services, and network switches (Cisco Catalyst 9300) for the private lines. The providers are expected to supply everything else.

Question 15: Regarding the CBO owned block of CLASS-B IP addresses which will need to be routable, will it need to be routed BGP or statically?

Answer: Typically, one class C address will be routed via BGP per internet circuit. As an

FYI, the CBO network also has its own AS number.

Question 16: What is the desired interface for all GigE services?

Answer: Layer 2 and 3.

Question 17: CBO requires that circuit activation at all three locations be accomplished within

45-days after contract award. Standard provisioning for 1-GB circuits is typically longer than this.

Questions and Answers for Solicitation No. CB18-RFQ0006 Page 3

A) Is the 45-day circuit delivery timeframe a firm requirement or would the CBO be amenable to extending this timeframe to 90 days, as an amendment to the solicitation?

B) What is the business impact to the CBO should offerors propose circuit delivery timeframes exceeding 45 days?

C) What evaluation rating (1-5) would an offeror receive for the criteria of “Circuit Delivery Timeframe” if, for example, they proposed a circuit delivery timeframe of 90 days?

Answer: See answer to Question 6.

Question 18: Key Personnel Requirements - Requires “all personnel involved” be within the

US… offeror understands this requirement applies to personnel involved in the provisioning, implementation, and monitoring of the service who would have access to CBO data; not to billing/invoicing personnel, for example, who would not have that access. Please confirm.

Answer: Yes, your understanding is correct. See the clarification to SOW ¶4(b) in Amendment No. 001.

Question 19: Will a single ethernet handoff from a service provider, with that ethernet circuit optically protected through the service providers network on diverse paths, support the CBO requirement for redundancy and no single point of failure?

Answer: We will consider it, if the offeror can provide detailed technical specifications in their proposal which will allow CBO to make the final determination.

Question 20: What type of equipment will the service provider be connecting to for the C1 and

C2 circuits?

Answer: See answer to Question 14.

Pricing & Proposal Questions

Question 21: Can the term be extended beyond 12 months to 24 / 36 / 60 months (This could help reduce costs) Answer: The RFP requests pricing from offerors for two performance period structures:

One is the typical Base Year plus Option Years structure with five 12-month periods that aligns with the annual appropriations that CBO receives. The second is a Multi-Year structure with a Base Period of 3 years with one Option Period of 2 years. The Multi-Year structure is included with the understanding that a longer term can result in a lower cost to the government.

Question 22: The Government requests provisions for cancellation of services after the 1st and

2nd year, is it the Governments intent that if they keep the service after two years, they will keep it for the remainder of the options years? Or will the Government consider revising the RFP to add provisions to cancel in any of the remainder of the out years.

Answer: The inclusion of an option period allows the government to continue a contract if the need still exists and funding is available. CBO cannot guarantee that we will receive a sufficient appropriation to cover all our contract expenses each year, so the ability to either not renew a contract or to terminate a contract early is always a right of the government. The clause CBO 217-02, Cancellation Under Multi-year Contracts, allows the government to end the contract early during the Base

Questions and Answers for Solicitation No. CB18-RFQ0006 Page 4

Period only if sufficient appropriations are not received and triggers any applicable cancellation charge. The clause CBO 249-02, Termination for Convenience, allows CBO to end the contract early for reasons other than funding availability or default by the contractor and can be invoked at any time during the contract period.

Question 23: The evaluation table in section 6, shows that the total score is up to 30 points.

However, four evaluation criteria only allow for a maximum point total of 20. Will the Government consider amending the evaluation table?

Answer: See the revision to the table at RFQ §4 ¶6, CBO 212-02, Evaluation— Commercial Items, in Amendment No. 001.

Question 24: Can we submit multiple bids? (i.e. 1 for all circuits and 1 for Internet Service at the ByteGrid Data Center in Silver Spring, MD) Answer: Yes, CBO will accept multiple proposals. (See RFQ §4, ¶3(e) of provision

CBO 212-01, Instructions to Offerors – Commercial Items.) Multiple configurations may be included in the same proposal provided the related pricing for each solution is clearly delineated.

Question 25: Based on the timeline, will CBO provide a 2-week or 3-week extension to the

May 31 offer due date?

Answer: Yes, see Amendment No. 001 for the extension to the offer due date.

Question 26: The Pricing Sheet is currently in PDF format. Would CBO consider providing a

MS WORD version of same?

Answer: The Circuit Pricing Worksheet can be found as an Excel spreadsheet at

FedBizOpps.gov at: https://www.fbo.gov/spg/CBO/CBOCBO/PS/CB18- RFQ0006/packages.html.

Question 27: Will CBO accept Docusign for signature requirements in the response?

Answer: Yes.

Question 28: We respectfully request a 3 week extension of the current due date of

May 31, 2018.

Answer: See answer to Question 25.

Question 29: Will the CBO please amend the solicitation to confirm whether the pricing requested in Schedules 1A, 2A, 1B, and 2B is for a quantity of two (2) 1GBPS point-to-point circuits, or one (1) 1GBPS point-to-point circuit.

Answer: The Circuit Pricing Worksheet has been revised to clarify the pricing schedule detail requested. The revised spreadsheet can be found at the link provided in Question 26.

Question 30: Termination for Convenience – Offeror desires CBO confirm that the clause within CBO 249-02, “…reasonable charges the Contractor can demonstrate to the satisfaction of CBO have resulted from the termination.” does not take precedence over the charges, up to the Cancellation Ceilings set forth in Schedules 1B through 4B within Offeror’s proposal, entitled to Offeror in the event of a termination for convenience by CBO. Please amend the solicitation to clarify.

Questions and Answers for Solicitation No. CB18-RFQ0006 Page 5

Answer: See answer to Question 22 in reference to the operation of the Multi-year Cancellation clause and the Termination for Convenience clause. See also paragraph (b) of clause CBO 217-02.

Question 31: Will the CBO accept a proposal to upgrade services provided through an existing

GSA contract, as part of the Offeror’s solution?

Answer: Yes.

Question 32: Please confirm that notwithstanding the last sentence of this section [CBO 212-

01(b)(1)(xi)], “Offers that...reject the terms and conditions of the solicitation may be excluded from consideration.”, that if the Offeror takes exception or proposes different terms (which is allowed by CBO 201-01 Terms and Conditions Limited as long as the CBO expressly agrees to such different terms) in a few instances, then it will not be excluded from consideration for this solicitation. Please amend the solicitation to clarify.

Answer: Offers may propose alternate terms and conditions (see paragraph (e) of provision CBO 212-01) which will be considered.

Question 33: Instructions for Preparing the Pricing Offer Section as written [RFQ §4, (b)(2)a. of provision CBO 212-101] provides CBO the right to terminate “for SLA deficiencies.” We request the CBO revise the language in such section so that SLA metrics not met do not provide the CBO the ability to terminate for default, especially where the Offeror provides SLA Credits as a remedy for SLA deficiencies. Note that the CBO has requested SLA commitments on several metrics. In the commercial telecommunications marketplace, it is industry standard to provide customer SLA Credits if pre-determined thresholds of such metrics are not attained within a given month. Please amend the solicitation to clarify.

Answer: CBO will accept SLA credit as a remedy, but the government always reserves the right to terminate due to default, for which excessive SLA deficiencies could be considered a reason. See the revision to the provision at RFQ §4 ¶5, CBO 212-101, in Amendment No. 001.

Part 2 – Contract Clauses

The following clause applies to Open Market orders:

1A. CBO 201-01 Terms and Conditions Limited (May 2003) This contract expressly limits acceptance to terms and conditions stated herein. Any additional or different terms and conditions proposed by the Contractor are rejected unless expressly agreed to by the Congressional Budget Office (CBO) in writing. If the Contractor commences shipment or performance pursuant to this contract, then the Contractor shall be deemed to have agreed to and accepted this contract in its entirety, including its terms and conditions as set forth herein.

The following clause applies to GSA Schedule orders:

1B. CBO 201-01 Terms and Conditions Limited (May 2003) Alternate I (July 2004) The instant action is subject to the terms and conditions under the GS Schedule number referenced in Block 2 of the award form, as supplemented by the following terms. If any of the terms or conditions in the GS Contract and this supplement are inconsistent, the terms and conditions of the GS Schedule shall govern, unless otherwise agreed between the parties.

2. CBO 201-02 Endorsements/News Releases/Advertising (May 2003) The Contractor agrees not to refer to this contract or CBO, in advertising, promotional or any other materials, in such a manner as to state or imply that the products or services provided are endorsed or preferred by CBO or are considered by CBO to be superior to other products or services. No news release, press conference, or advertisement pertaining to this contract will be distributed or broadcast without prior written approval by CBO.

3. CBO 203-170 Contractor Employee Whistleblower Rights (Dec 2014) The Contractor shall not require any employees or contractors of the Contractor seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

4. CBO 211-101 Performance Period – Base Contract and Options (Feb 2007)

(a) If a Base + Options contract is awarded, the overall performance period of this contract will consist of the following time periods:

(1) The performance period for Line Item No. 001, Provisioning, of the contract will commence on the date of contract award and extend for 45 calendar days (or the amount of time proposed in the Contractor’s offer, whichever is lessmore).

(2) The performance period for Line Item No. 002, Base Year, of the contract will commence on the day immediately following the end of the Provisioning period (Line Item No. 001) and extend one calendar year.

(3) If each successive option period is exercised (see contract clause CBO 217-09, Option to Extend the Term of the Contract), the performance periods for Option Years 1 through 4 will begin the day after completion of the base period and extend for 12 months each.

(b) If a Multiyear + Option contract is awarded, the overall performance period of this contract will consist of the following time periods:

(1) Contract performance of provisioning will commence on the date of contract award and extend for 45 calendar days (or the amount of time proposed in the Contractor’s offer, whichever is lessmore).

(2) The performance period for Line Item No. 001, Base Period, of the contract will commence on the day immediately following the end of the Provisioning period and extend for three calendar years.

(3) If the option period is exercised (see contract clause CBO 217-09, Option to Extend the Term of the

Contract), the performance period for the Option Period will begin the day after completion of the Base Period and extend for two calendar years.

5. CBO 212-04 Compliance with Laws (Jan 2015) The Contractor shall comply with all applicable Federal, State, and local laws, rules and regulations applicable to its performance under this contract. The Contractor further agrees to hold CBO harmless from any and all liabilities, claims, Amendment No. 001 to Solicitation No. CB18-RFQ0006 Page 6 of 39 fines, penalties, including reasonable costs and settlements, which may arise out of the delivery by the Contractor of goods or supplies or the furnishing of services that do not meet the requirements of any applicable laws or regulations.

6. CBO 217-02 Cancellation Under Multi-Year Contracts (Oct 1997)

(a) “Cancellation,” as used in this clause, means that the Government is canceling its requirements for all supplies or services in program years subsequent to that in which notice of cancellation is provided. Cancellation shall occur by the date or within the time period specified in the Schedule, unless a later date is agreed to, if the Contracting Officer—

(1) Notifies the Contractor that funds are not available for contract performance for any subsequent program year; or

(2) Fails to notify the Contractor that funds are available for performance of the succeeding program year requirement.

(b) Except for cancellation under this clause or termination under the Default clause, any reduction by the Contracting Officer in the requirements of this contract shall be considered a termination under the Termination for Convenience clause.

(c) If cancellation under this clause occurs, the Contractor will be paid a cancellation charge not over the cancellation ceiling specified in the Schedule as applicable at the time of cancellation.

(d) The cancellation charge will cover only—

(1) Costs—

(i) Incurred by the Contractor and/or subcontractor;

(ii) Reasonably necessary for performance of the contract; and

(iii) That would have been equitably amortized over the entire multi-year contract period but, because of the cancellation, are not so amortized; and

(2) A reasonable profit or fee on the costs.

(e) The cancellation charge shall be computed and the claim made for it as if the claim were being made under the Termination for Convenience clause of this contract. The Contractor shall submit the claim promptly but no later than 1 year from the date—

(1) Of notification of the nonavailability of funds; or

(2) Specified in the Schedule by which notification of the availability of additional funds for the next succeeding program year is required to be issued, whichever is earlier, unless extensions in writing are granted by the Contracting Officer.

(f) The Contractor’s claim may include—

(1) Reasonable nonrecurring costs (see Subpart 15.4 of the Federal Acquisition Regulation) which are applicable to and normally would have been amortized in all supplies or services which are multi-year requirements;

(2) Allocable portions of the costs of facilities acquired or established for the conduct of the work, to the extent that it is impracticable for the Contractor to use the facilities in its commercial work, and if the costs are not charged to the contract through overhead or otherwise depreciated;

(3) Costs incurred for the assembly, training, and transportation to and from the job site of a specialized work force; and

(4) Costs not amortized solely because the cancellation had precluded anticipated benefits of Contractor or subcontractor learning.

(g) The claim shall not include—

(1) Labor, material, or other expenses incurred by the Contractor or subcontractors for performance of the canceled work;

(2) Any cost already paid to the Contractor;

(3) Anticipated profit or unearned fee on the canceled work; or

(4) For service contracts, the remaining useful commercial life of facilities. “Useful commercial life” means the commercial utility of the facilities rather than their physical life with due consideration given to such factors as location of facilities, their specialized nature, and obsolescence.

Document No. 1 – Statement of Work

Datacenter Migration – Phase 2 Internet and Private Circuit

1. Agency Background The Congressional Budget Office (CBO) is a small legislative branch agency that provides economic and budgetary analysis to the U.S. Congress to aid in policy decisions. The agency’s research, analysis, and reports include baseline and long term budget projections, formal and informal cost estimates on pending legislature, scorekeeping reports, and an analysis of the President’s budget.

CBO’s Information Resource Management (IRM) unit has oversight of all the agency’s information technology operations and is responsible for implementing and maintaining all IT infrastructure, systems, and operations. IRM supports a staff of 245 employees providing services, devices, and systems that include helpdesk, applications, desktops, printers, network, Wi-Fi, telework, cybersecurity, mobile devices, disaster recovery, backup, email, data storage, and Internet connectivity.

2. Objectives CBO has a requirement for Internet and private circuits to connect the agency’s three datacenter facilities. CBO is currently redesigning its datacenter architecture to enable IT service redundancy and improve the agency’s ability to provide business continuity. These circuits are part of this overall redesign strategy. CBO’s current datacenter infrastructure includes the Ford House Office Building (FHOB) in Washington, DC, where the agency’s headquarters are located, and the Alternate Computing Facility (ACF) datacenter located in Manassas, Virginia. CBO’s IT infrastructure supports 245 users. A private DWDM circuit connecting CBO’s FHOB and ACF datacenters already exists and is provided through a contract with Verizon that is administered by the U.S. House of Representatives’ House Information Resources (HIR) office. FHOB currently serves as CBO’s primary datacenter with the ACF location serving as the agency’s backup datacenter. The agency’s primary Internet connectivity is also currently at FHOB with backup connectivity at ACF. CBO uses the same Internet service provider, Level 3 Communications/CenturyLink, at both facilities.

Due to space and power limitations at CBO’s FHOB datacenter, IRM has devised a datacenter infrastructure redesign that shifts the primary datacenter from FHOB to ACF and moves the backup datacenter role to a new co-location datacenter managed by ByteGrid. The ByteGrid facility is located in Silver Spring, Maryland.

The datacenter infrastructure redesign requires establishing a new private circuit connectivity between the ACF primary datacenter and a new ByteGrid backup datacenter. The requirements also include establishing another new private circuit connectivity between the FHOB and the ByteGrid datacenters. Regarding Internet connectivity, the requirement is for new public Internet circuits at both ACF and FHOBByteGrid.

The Contractor shall provide the private circuits connectivity between ACF and ByteGrid and between FHOB and ByteGrid. The Contractor shall also provide the required public Internet services at the ACF and ByteGrid datacenters.

The Contractor shall provide all or part of the Internet and private circuits required (detailed bandwidth requirements are provided in the Scope of Work at section 3 below). The attached diagram in Appendix B shows the datacenter redesign and existing and new required links between the agency’s datacenter locations. Also attached in Appendix A are the addresses for each datacenter included in the redesign. These addresses can be used to determine the distance between the datacenter locations.

To reduce the risk of circuit failure from dependency on a single provider for the required primary and backup circuits, CBO will evaluate and award the required circuit contracts with the aim of vendor diversity. This means that no single provider will be awarded all the required Internet and point-to-point circuits. (See also paragraph (h), Multiple Awards, of solicitation provision CBO 212-01, Instructions to Offerors – Commercial Items, in Part 4.) The term “Contractor” in this SOW shall refer to either or both Contractors, individually and collectively.
