About this file
This is a Questions and Answers document issued by the New York State Office of Addiction Services and Supports (OASAS) regarding solicitation 26023 for the development of a Caring Adult Gambling Prevention for Youth Toolkit. The toolkit is designed for caring adults including parents, guardians, caregivers, educators, community leaders, coaches, and mentors who interact with youth ages 10 through 18. The project deliverables include toolkit pages, educational activities (anticipated at 3-5 based on final content agreement), and standalone digital assets to be determined collaboratively with the vendor. OASAS will evaluate proposals based on combined team qualifications including the prime firm, key personnel, and identified subcontractors, with subcontractors required to meet qualifications for their respective scope of work portions. The toolkit must incorporate the existing OASAS Take a Pause campaign branding and comply with Web Content Accessibility Guidelines 2.2 Level AA standards. The project includes conducting six focus groups total—two each with youth participants, caring adults, and key stakeholders—with no more than 8-10 participants per group. Virtual focus groups are acceptable, and the vendor may propose up to $20 in gift card compensation per participant across the two focus groups.
Vendors should propose their standard billing milestones for similar projects, subject to OASAS review and potential renegotiation if deemed unreasonable or unfair. All contractors must provide proof of compliance with New York State Workers' Compensation and Disability Benefits coverage requirements through an insurance carrier, Board-approved self-insurance status, or legal exemption. The solicitation includes a 30 percent Minority/Women-Owned Business Enterprise (M/WBE) participation goal; only M/WBE firms certified by New York State Empire State Development count toward this goal if achieved through subcontracting. M/WBE Utilization Plans, SDVOB Utilization Plans, Vendor Responsibility Questionnaires, and NYS Vendor ID are not required with the proposal but will be required during contract development with the selected vendor. Required submission documents are limited to the nine items specified in Section 8 of the solicitation, with no page limit specified in this document.

OASAS 26023- Caring Adult Gambling Prevention for Youth Toolkit Development- Questions & Answers:
1. Evaluation of team experience: For the six minimum eligibility requirements, will OASAS evaluate the combined qualifications and relevant project experience of the proposed team, including the prime firm, key personnel, and identified subcontractors? Please identify any requirements that must be demonstrated exclusively by the prime firm.
Evaluation of the vendor will be as a proposed team. If the vendor subcontracts out for any of the SOW, the subcontractor must meet the qualifications to carry out the
SOW.
2. Deliverable quantities and accessibility: Are there anticipated quantities for toolkit pages, educational activities, and standalone digital assets? Which accessibility standard and testing requirements should vendors use when preparing their proposals?
OASAS will look to the vendor to determine the appropriate number of pages based on the required content outlined in the scope of work. The set number of educational activities will be determined with the vendor and OASAS but it is anticipated there will be 3-5 depending on the final agreed upon content of the materials presented. The set number of digital assets will be determined with the vendor and OASAS. As outlined in the SOW, it will be in conjunction with the current OASAS Take a Pause campaign and may be incorporated with already developed materials . Accessibility must meet the Level AA of the Web Content Accessibility Guidelines 2.2. More info at Accessibility Toolkit | The State of New York. 3. Focus groups: Please confirm the required number of groups, expected participants per group, whether virtual sessions are acceptable, and responsibility for recruitment and participant compensation.
Focus groups will include a youth focus group, caring adults focus group, and key stakeholders focus groups of no more than 8-10 participants each. It is anticipated that there will be two focus groups for each of the three targeted audiences. Virtual is acceptable. The vendor will be primarily responsible for recruitment and OASAS may assist if needed.
4. Billing and insurance: What milestone billing, acceptance procedures, and payment timeframes are anticipated? Please also identify the required insurance coverage and limits.
Milestone billing:
The vendor should propose their standard billing milestones that they have used for similar projects. OASAS will review the milestones to ensure that they are acceptable to the state and are reasonable and fair. OASAS may renegotiate new billing milestones if the proposed milestones are deemed to be unreasonable or unfair.
Insurance Coverage Requirements:
Proof of Compliance with Workers’ Compensation Coverage Requirements - In order to provide proof of compliance with the requirements of the Workers’ Compensation Law pertaining to workers’ compensation coverage, a contractor shall: (1) obtain such coverage from an insurance carrier; or (2) be a Workers’ Compensation Board-approved self-insured employer or participate in an authorized self-insurance plan; or (3) be legally exempt from obtaining Workers’ Compensation insurance coverage.
Proof of Compliance with Disability Benefits Coverage Requirements - In order to provide proof of compliance with the requirements of the Workers’ Compensation Law pertaining to disability benefits, a contractor shall: (1) obtain such coverage from an insurance carrier; or (2) be a Board-approved self- insured employer; or (3) be legally exempt from obtaining disability benefits coverage.
5. Comparable experience: For minimum eligibility requirement 1, may the vendor meet the comparable-experience requirement through a qualifying project completed by an identified subcontractor or key team member who will perform that work on this project?
See answer to question 1
6. Required submission documents: Could you please confirm the complete list of documents a proposal must include to be considered? Beyond the nine items listed in Section 8 (Proposal Requirements), are any additional forms or attachments required, such as a Vendor Responsibility Questionnaire, NYS Vendor ID, or other standard procurement forms? Is there a preferred file format or page limit for the full proposal?
The required submission documents are listed in the solicitation Section 8- Proposal Requirements.
Vendor Responsibility, NYS Vendor ID and other procurement forms are not due with proposal. OASAS will require those from the selected vendor during contract development.
7. M/WBE and SDVOB participation: Are vendors required to submit an M/WBE Utilization Plan, SDVOB Utilization Plan, or related forms with the proposal? If so, could you please share the forms or indicate where they can be found?
No, they are not required with the proposal.
8. M/WBE certification: To count toward the 30% M/WBE goal, must firms be certified by NYS Empire State Development, or are other certifications (such as NYC Small Business Services WBE certification) also accepted?
The selected vendor does not need to be certified if they are meeting the goal with subcontracting. If achieving the goal through subcontracting, the subcontractor(s) must be certified by NYS ESD for utilization to be counted towards the goal.
9. Would you be available for a brief call this week? Given the November 6 deadline, I can quickly provide our scope, pricing, and proposal-ready language. Our capability statement is attached.
