About this file
These are bid proposal submission forms for the Capouse Avenue Park Renovation Project, issued by the City of Scranton, Pennsylvania. The comprehensive bid documents outline a municipal park renovation project that includes multiple components such as site preparation, demolition, surface infrastructure improvements, stormwater management, landscaping, recreation facilities, and building construction. The project involves installing a splash pad, playground, parking lot, walkways, concrete curbing, fencing, utilities, and associated site work. Substantial completion is required within 180 days of the Notice to Proceed, with full project completion targeted by the end of April 2025. Sealed bids will be received online through the City's e-Procurement Portal until 10:00 am on Thursday, August 1, 2024, with a bid opening to follow in City Council Chambers.
The bid documents include detailed line-item pricing for seven project sections, with contractors required to provide unit costs for each item. Bidders must submit comprehensive documentation including a Contractor Information Form, Statement of Bidder's Qualifications, Bid Bond (10%), Non-Collusion Affidavit, Employment Verification Form, and various non-discrimination and equal opportunity certifications. The project appears to be funded through municipal sources, with specific requirements for contractor qualifications, including compliance with equal employment opportunity regulations, verification of employee eligibility, and adherence to non-segregation policies. Contractors will be evaluated based on their technical capabilities, past performance, and ability to meet the project's complex infrastructure and recreational facility renovation requirements.

NONDISCRIMINATION / EQUAL OPPORTUNITY / SEXUAL
HARASSMENT CLAUSES / POLICY
Nondiscrimination and equal opportunity are the policy of the Commonwealth and The City of Scranton in all its decisions program, and activities. The purpose is to achieve the aims of the United States and
Pennsylvania Constitutions. Executive Order 1972-1, the Pennsylvania Human Relations Act, Act of
October 27, 1955, (P.L. 744), as amended, (43 P.S. 951, et. seq.), and (43 P.S. 153), by assuring that all persons are accorded equal employment opportunity without regard to race, color, religious creed, handicap, ancestry, national origin, age, or sex.
Sexual harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexually harassing nature, when: (1) submission to the harassment is made either explicitly or implicitly a term or condition of employment; (2) submission to or rejection of the harassment is used as the basis for employment decisions affecting the individual; or (3) the harassment has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment. It is the policy of The City of Scranton that all Township-owned and operated workplaces, including recreational facilities, are free from sexual harassment. Because of The City of Scranton’s strong disapproval of offensive or inappropriate sexual behavior at workplaces, any contractor hired by The City of Scranton must also assure that all of their employees avoid any action or conduct which could be viewed as sexual harassment.
During the term of this contract, the Contractor agrees as follows:
5. In the hiring of any employee(s) for the manufacture of supplies, performance of work, or any other activity required under the grant agreement or any subgrant agreement, contract, or subcontract, the Grantee, a subgrantee, a contractor, a subcontractor, or any person acting on behalf of the Grantee shall not discriminate by reason of race, gender, creed, color, sexual orientation, gender identity or expression, or in violation of the
Pennsylvania Human Relations Act (PHRA) and applicable federal laws, against any citizen of this commonwealth who is qualified and available to perform the work to which the employment relates.
6. The Grantee, any subgrantee, contractor or any subcontractor or any person on their behalf shall not in any manner discriminate by reason of race, gender, creed, color, sexual orientation, gender identity or expression, or in violation of the PHRA and applicable federal laws, against or intimidate any of its employees.
7. Neither the Grantee nor any subgrantee nor any contractor nor any subcontractor nor any person on their behalf shall in any manner discriminate by reason of race, gender, creed, color, sexual orientation, gender identity or expression, or in violation of the PHRA and applicable federal laws, in the provision of services under the grant agreement, subgrant agreement, contract or subcontract.
8. Neither the Grantee nor any subgrantee nor any contractor nor any subcontractor nor any person on their behalf shall in any manner discriminate against employees by reason of participation in or decision to refrain from participating in labor activities protected under the Public Employee Relations Act, Pennsylvania Labor
Relations Act or National Labor Relations Act, as applicable and to the extent determined by entities charged with such Acts’ enforcement, and shall comply with any provision of law establishing organizations as employees’ exclusive representatives.
9. The Grantee, any subgrantee, contractor or any subcontractor shall establish and maintain a written nondiscrimination and sexual harassment policy and shall inform their employees in writing of the policy.
The policy must contain a provision that sexual harassment will not be tolerated and employees who practice it will be disciplined. Posting this Nondiscrimination/Sexual Harassment Clause conspicuously in easily-accessible and well-lighted places customarily frequented by employees and at or near where the grant services are performed shall satisfy this requirement for employees with an established work site.
NONDISCRIMINATION / EQUAL OPPORTUNITY / SEXUAL HARASSMENT CLAUSE
10. The Grantee, any subgrantee, contractor or any subcontractor shall not discriminate by reason of race, gender, creed, color, sexual orientation, gender identity or expression, or in violation of the PHRA and applicable federal laws, against any subgrantee, contractor, subcontractor or supplier who is qualified to perform the work to which the grant relates.
11. The Grantee and each subgrantee, contractor and subcontractor represents that it is presently in compliance with and will maintain compliance with all applicable federal, state, and local laws and regulations relating to nondiscrimination and sexual harassment.
