Control No: CAO-21-0249
Contractor: International Business Machines Corporation Program/Equipment: PD ALTESS Information Technology Support Services
Justification and Approval for Other Than Full and Open Competition
1. Contracting Activity: U.S. Army Contracting Command – New Jersey
2. Description of Action: The Program Executive Office (PEO) Enterprise Information System, Product Director Acquisition, Logistics and Technology Enterprise Systems and Services (PD ALTESS) intends to award a Cost-Plus-Fixed-Fee bridge contract with International Business Machines Corporation (IBM), 6710 Rockledge Drive, Bethesda, Maryland, 20817-1834, for the continuation of Information Technology Support Services (ITSS). The Government projects award for 13 April 2021, and fiscal year 2021 Operations and Maintenance, Army type funds are available and will be utilized for this effort.
3. Description of Supplies/Services: PD ALTESS provides enterprise class data center services to include business systems hosting, software design, systems engineering, service-level management, information assurance, cloud support, cyber support, financial and business management, and enterprise service desk operations for PD ALTESS hosted customers and associated users throughout the Department of Defense (DoD). The proposed action will provide for a continuation of ITSS from the current action being conducted under Contract Number W91QUZ06D0010, Task Order 2T01, to prevent a break in service. These support requirements include PD ALTESS core Information Technology (IT) mission, customer reimbursable services operations, and sustainment operations. Task areas include Systems Engineering Operations, Financial and Acquisition Operations and Application Modernization and Sustainment, Service Desk Operations, Cloud Support, Continuous Network Security Monitoring and Intrusion Detection, Incident Response Analysis and Operations, Attack Sensing and Warning, Service-Level Business Operations, and Network Operations for two major data centers located at Radford, Virginia, and Ft. Bragg, North Carolina.
The proposed bridge modification will have a Period of Performance of three months.
The dates and estimated value are provided in the table below.
Bridge Period of Performance Start Date End Date Value
14 April 2021 13 July 2021
The award of Contract Number W91QUZ-06-D-0010, Task Order 2T01 provided for fair opportunity to all Computer Hardware Enterprise Software and Solutions (CHESS) Information Technology Enterprise Solutions – 2 Services (ITES-2S) multiple award contract holders. This contract is a follow-on to the 11-month bridge modification, Modification 0028, which was awarded on 30 April 2020, as an undefinitized contract action (UCA), pursuant to the authority of Federal Acquisition Regulation (FAR) 16.603- 2(a), that the Government’s interests demand that the Contractor be given a binding commitment so that work can start immediately and that negotiating a definitive contract is not possible in sufficient time to meet the requirements. The UCA was supported by an
Exception to Fair Opportunity Justification (EFOJ) under the authority of 10 United States Code (U.S.C.) 2304c(b)(3), as implemented by FAR 16.505(b)(2)(i)(C), which states “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.” The EFOJ was approved by , Senior Contracting Official, on 20 April 2020. Paragraph, “Actions to Increase Competition” of the previous justification, stated: “The Government is currently developing a requirements package for a competitive follow-on effort. Fair opportunity will be provided to contract holders under the Army’s CHESS ITES-3S contract vehicle, with award forecasted for March 2021;
inclusive of a 30-day transition period allowing for sufficient time for contractors to phase-out and phase-in.” Those actions were not accomplished within the forecasted timeframe due to the complexity of the PD ALTESS ITSS requirement, for which the Government received approximately industry questions in response to Request for Task Order Proposal (RTOP), Number W15QKN21R0015. The Government received proposals from interested sources by the closing date and time of the RTOP.
Due to the , the Government requires additional time to complete evaluations, and conduct a best value source selection in accordance with the criteria set forth in its competitive solicitation.
4. Authority Cited: 10 U.S.C. 2304(c)(2) as implemented by FAR Part 6.302-2(a)(2) – Unusual or Compelling Urgency. When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
5. Reason for Authority Cited: Task Order 2T01 provided for fair opportunity to all CHESS ITES-2S contract holders with award made to IBM on 2 September 2016, against Contract Number W91QUZ06D0010, which represented the best value to the Government based upon the criteria set forth in the Government’s Request for Task Order Proposal number W15QKN16R0017. Task Order 2T01 was awarded with a period of performance of 03 September 2016 through 02 May 2020. On 30 April 2020 the Task Order was extended via an Exception to Fair Opportunity pursuant to 10 U.S.C.
2304c(b)(3) as implemented by FAR 16.505(b)(2)(i)(C). The exception states “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.” The task order period of performance was extended by 11 months, from 03 May 2020 through 13 April 2021, and was awarded as a UCA, which was definitized on 30 June 2020. Based upon the precedence set forth in the United States (U.S.) Government Accountability Office (GAO) decision on the matter of AllWorld Language Consultants, LLC, File Number B-411481.3, dated 6 January 2016, the Government is unable to extend the period of performance of Task Order 2T01 under the existing CHESS ITES-2S Contract Number W91QUZ06D0010, which expires on 13 April 2021. GAO’s decision in that matter concluded:
Changed Circumstances: Contract Number W91QUZ-06-D-0010, Task Order 2T01 provided for fair opportunity to all CHESS ITES-2S multiple award contract holders. The intent of this action is to award a three month bridge effort to continue mission essential services for the PD ALTESS, while the Government completes its best value source selection under RTOP Number
W15QKN21R0015.
Unusual patterns: No unusual patterns have been revealed based upon the history of this requirement.
Significant Changes: Not Applicable
