Questions and Answers

1. Does the Combined Synopsis/Solicitation under solicitation number CAFYSTATE contain requirements similar to a current contract? If possible, please provide the current contract number. Or, is this a new requirement for the government?

Response: Yes, current contract number is 60-9182-7-C1705.

2. Is there an incumbent and what was the prior awarded amount for the services provided?

Response: Yes. The incumbent is Fidelity National Title Company. Their BPA is for $50,000. As of 3/7/2017, which represents five (5) months of awards, $23,119.34 has been awarded so far.

3. What is the anticipated volume or number of estimated foreclosures with a calendar year?

Response: A BPA does not guarantee any task orders to be awarded. However, over the past couple of years, it has taken roughly two years to exhaust the $100,000.

4. How many firms will be on the BPA?

Response: Two firms will be awarded BPA’s for $100,000 each.

5. We are a trustee that has handled non-judicial foreclosures for many years, but we are not an attorney. Since the BPA includes eviction services, can the trustee use an attorney as one of their vendors to handle this process? Can you provide historical information on average number or percentage of files requiring eviction?

Response: Yes, a trustee can use an attorney as a subcontractor to handle the eviction process.

Historical data is not available for the number of evictions.

6. Section C.18 Quarterly reports states:

“Upon filing of a bankruptcy petition, the Contractor report shall include the filing date of the petition, motions filed by the debtor, the date of confirmation or dismissal, and information regarding relief from stay”.

This is the only area I find regarding bankruptcy. Is the contractor also expected to hire counsel to represent the USDA in court or will the OGC handle this once notified of the bankruptcy filing?

Response: No, the contractor would not be required to hire counsel to represent USDA in court. Generally bankruptcies are handled by CSC.
