JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Training Systems Division (NAWCTSD) Orlando, FL.
2. Description of the Action Being Approved.
This justification and approval authorizes on a sole source basis, a contract providing C-26D training to be accomplished over a five-year period to FlightSafety International Inc. (FSI). This will be a Firm Fixed Price Contract. FSI is the present contractor awarded under J&A# 15-24429 as a sole source.
Its address is: Marine Air Terminal La Guardia Airport Flushing, NY 11371-1061.
3. Description of Supplies/Services.
The C-26D Contract is comprised of acquiring C-26D training for student pilots. The contractor is required to provide: all labor, equipment, training facilities, tools, training materials, training devices, supervision and other services necessary for classroom, trainer, and simulator training for the Navy C- 26D ProLine 21 aircraft (a Navy configured Metroliner SA227). The present contract ends on 31 July 2020 and the new contract must be in place to continue training on 1 August 2020.

4. Statutory Authority Permitting Other Than Full and OpenCompetition.
10 U.S.C. 2304(c) (1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
FSI is the only source available for the required C-26D training. The use of a flight simulator is required by the FAA to obtain flight training in conjunction with the approved training course curriculum. FSI owns and operates the only FAA certified C-26 (Metroliner SA227) flight simulator in the country. Thus, training on a FAA certified C-26 flight simulator is a unique service available from only FSI.
6. Description of Efforts Made to Solicit Offers from as Many Offerors asPracticable.
A Sources Sought synopsis was posted to the Navy Electronic Business Opportunities (NECO) web site on 12 Sep 2019. There was one response to this posting, FSI, International. Furthermore, a synopsis with a redacted copy of the J&A will be published through the Government-wide point of entry (GPE) in accordance with special documentation requirements in FAR Subpart 13.501.
7. Determination of Fair and Reasonable Cost.
This acquisition will utilize simplified acquisition procedures under Subpart 13.5 – Simplified Procedures for Certain Commercial Items, which provides special authority for acquisitions of commercial items exceeding the simplified acquisition threshold but not exceeding $7 million. The purpose of simplified procedures is so a commercial item acquisition is solicited, offered, evaluated, and awarded in a simplified manner to maximize efficiency and economy and minimize burden and administrative costs for both the Government and industry (10 U.S.C.2304(g) and 2305 and 41 U.S.C.3305, 3306, and chapter 37, Awarding of Contracts.
In accordance with FAR 13.106-3(a)(2), the Contracting Officer must include a statement of price reasonableness when only one response is received. Analysis of the proposal will be performed by technical analysts and contract specialists, ensuing the price reasonableness is based on the following (refer to FAR subpart 13.106-3(2)(i) to (vii)):
Market research;
Comparison of the proposed price with prices found reasonable on previous purchases;
Current price lists, catalogs, or advertisements;
A comparison with similar items in a related industry;
The contracting officer’s personal knowledge of the item being purchased;
Comparison to an independent Government estimate; or
Any other reasonable basis.
As discussed in this paragraph, the PCO will utilize data and information recognized under FAR 13 as validated sources when determining fair and reasonable pricing for the services covered by this J&A.
8. Actions to Remove Barriers to FutureCompetition.
The CACT program continues to be proactive in seeking additional sources. Information concerning all the Navy's C-26D models' training requirements is announced at the Training and Simulation Industry Symposium, held at least once a year. Should additional qualified training sources become available, the contracting office may elect to forego the exercising of this contract's option(s) and recompete the requirement, if this course of action is determined to be in the Government's interest.
