About this file

This is a Procurement Exemption Request Form submitted by Home Forward, a local housing authority in Oregon, seeking approval for a sole source procurement exemption to purchase a FloLogic leak detection system for Civic Station, a 60-unit apartment building under construction in Gresham. The project involves installing a comprehensive leak detection and automatic shut-off system throughout the five-story residential building and first-floor community space that includes an early learning center. The procurement includes 120 one-inch leak detectors with shutoff valves (one for each apartment's hot and cold water lines), 120 Legacy Control Panel kits, 240 pinpoint water sensors, and one two-inch leak detector, totaling 120 flow-metering valves and associated electrical coordination devices. The exemption request was submitted on August 31, 2026, with a protest deadline of seven calendar days from the publication date of September 3, 2026. Protests must be submitted via email to dzana.malagon@homeforward.org.

The total contract cost is $286,112, representing a 20% volume discount from FloLogic's standard pricing of $339,340. Home Forward justified the sole source exemption under Oregon Revised Statute 279B.075 based on two grounds: use in a pilot or experimental project and the availability of needed system qualities from only one source. The justification emphasizes FloLogic's unique combination of attributes, including 20+ years of industry longevity (purchased by Bradford White in 2024), commercial-grade durability with bronze and stainless steel components, sensitivity to detect leaks at half-an-ounce per minute flow rates, thread mesh network technology for wireless communication without WiFi energy demands, and a management app with no recurring fees. The procurement was reviewed by the Procurement & Contracts Manager and approved by Dzana Malagon, with the exemption applying exclusively to this individual contract.

ORS 279B.075

(1) A contracting agency may award a contract for goods or services without competition if the Director of the Oregon Department of Administrative Services, a local contract review board, a state contracting agency, if the state contracting agency has procurement authority under ORS 279A.050, the State Chief Information Officer, with respect to goods or services described in subsection (2)(b) of this section and if the director has delegated the necessary authority to the State Chief Information Officer, or a person designated in writing by the director, board or state contracting agency with procurement authority under ORS 279A.050 , determines in writing, in accordance with rules adopted under ORS 279A.065 (Model rules generally), that the goods or services, or class of goods or services, are available from only one source.

(2) The determination of a sole source must be based on writen findings that may include:

(a) That the efficient utilization of existing goods requires acquiring compatible goods or services;

(b) That the goods or services required to exchange software or data with other public or private agencies are available from only one source;

(c) That the goods or services are for use in a pilot or an experimental project; or

(d) Other findings that support the conclusion that the goods or services are available from only one source.

(3) To the extent reasonably practical, the contracting agency shall negotiate with the sole source to obtain contract terms that are advantageous to the contracting agency.

Civic Station is a 60-unit apartment building Home Forward has under construction in Gresham. The building has five floors of apartments above the first floor of community space and an early learning center.

In other Home Forward properties, flood events often create costly repercussions for units below the cause of the flooding. Tenants must be relocated while walls are opened up and allowed to dry. Flooding events are particularly problematic for commercial tenants, such as the early learning center at Civic Station, which must continue to operate during a flooding event and in its aftermath.

Leak detection systems have been developed over the past 30 years that will shut off water supplies if water flow indicates a leak or if a moisture sensor is triggered. Home Forward has yet to install a leak detection system throughout an entire building.

Development staff have worked with the Civic Station general contractor and plumbing subcontractor to identify FloLogic as a good leak detection system to install at Civic Station in an effort to limit and prevent flooding damage. Home Forward will purchase the equipment via this exemption request and the general contractor will get it installed. Equipment includes 120 flow metering valves (one for each apartment's hot and cold lines) and associated electrical devices to coordinate the valves' shut-offs.

This approach qualifies for a Sole Source Exemption both for its use in a "pilot or an experimental project" and based on findings that needed qualities of this leak detection system are available from only one source.

MEMORANDUM

Subject: Civic Station FloLogic Procurement

Exemption Request Form Attachment

Justification for Request

For use in a pilot or an experimental project

As noted in the background, Home Forward may see substantial cost savings from installing a leak detection system in a multi-story building, but no Home Forward building has yet been equipped with a comprehensive leak detection system. Should such a system prove workable over a long term at Civic

Station, it may lead to incorporating such systems in similar Home Forward buildings.

Needed qualities of this leak detection system are available from only one source

Though other leak-detection products and systems are available from other suppliers, none have the combination of qualities to meet the needs identified as most advantageous to Home Forward.

Need: The supplier must have longevity in the field to avoid installing a system that will become obsolete or lack support. Finding: FloLogic has produced leak detection products since 2000. It was purchased by Bradford White, a company with a 100+-year-history, in 2024.

Need: The installed equipment must be made with durable components. Finding: FloLogic is a commercial-grade system, cast bronze with stainless steel ball valves and teflon seals. It has a

5-year warranty available.

Need: Flow-based leak detection must have sensitivity to activate on even small leaks. Finding:

FloLogic detection is activated at a flow rate of half-an-ounce per minute.

Need: Wireless aspects of the leak detection system must not rely on WiFi due to its intense energy usage. Finding: FloLogic's pinpoint sensors communicate via a thread mesh network that uses less power and extends battery life.

Need: Shut-off valve management must be available through a phone app that does not require additional recurring costs. Finding: FloLogic systems can be managed via an app that does not currently assess any additional fees for use or features.

Price and advantage to the contracting agency

To install a comprehensive leak detection system at Civic Station, Home Forward will need 120 1-inch leak detectors/shutoffs, 120 Legacy Control Panel kits, 240 pinpoint water sensors, and one 2-inch leak detector/shutoff. FloLogic offers their leak detection systems for sale on their own website: 1-inch leak detectors/shutoffs for $2,190, each; Legacy Control Panels for $420, each; pinpoint water sensors for $95 each; and 2-inch leak detectors/shutoffs for $3,340, each. These listed prices equate to a cost to Home

Forward of $339,340.

These prices are fair. A simple Internet search shows that FloLogic systems can be found for sale on other websites as well. The prices offered directly from FloLogic match the prices listed on other web sources. Home Forward is not being subjected to premiums or inflation above what any buyer would pay for the FloLogic system.

These prices are reasonable. Again, a simple Internet search will find leak detection devices that cost considerably less than FloLogic, for example, the Moen Flo ($500-$700) and the Phyn Plus ($500-$600).

However, the search will also find results in the same range as FloLogic, for example Water Hero

($1,199+) and Leak Defense ($2,000+). The difference in pricing is tied to the qualities noted above. The higher-cost devices share more (but not all) of the needed qualities, and the lower-cost devices share fewer. Moreover, FloLogic has established its position in the industry over the last 20+ years by offering its devices at this price point. Given the qualities offered by the FloLogic system, Home Forward is not being offered prices that are without a basis established in the market.

FloLogic has offered an advantageous discount to Home Forward. Given the volume at which Home

Forward would be ordering its leak detection/shutoff systems, Flo Logic has offered 20% discount on those components. As a result, rather than paying the $339,340 for the listed price of all components, Home Forward will pay $286,112, realizing savings of $53,228.
