About this file
This is a Justification & Approval for Other Than Full and Open Competition form for a simplified acquisition over the micropurchase threshold, dated June 2, 2026, with PR Number 44045072.
The procurement is for hay required to feed bison during a September roundup and culling operation, with delivery required between September 1 and September 24. The contracting officer justified the sole source acquisition based on urgent and compelling circumstances rather than the availability of only one responsible source. The urgency derives from the critical timing of the roundup operation, which cannot proceed without hay on hand for the captured animals. The roundup is essential for reducing herd numbers to prevent over-population and resulting natural resource damage from over-grazing, a concern exacerbated by ongoing drought conditions that make maintaining acceptable stocking levels critical. Market research was not performed in the traditional sense, as hay functions as a market-based commodity with prices that fluctuate based on supply, demand, weather conditions, and regional availability rather than being sold at stable, preset prices. The form was signed by Mark Slovek Bio-Tech (appears to be a title or entity name) and contracting officer Joseph Kirk on June 4, 2026. The Warranted Individual 1 Level Above Contracting Officer signature line remains unsigned, indicating the approval chain was not completed on the document provided.

PR Number: 44045072_________________________
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
_Hay for September bison round up.
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
____X__ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on
Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: Delivery of hay should occur between September 1 and September 24, before the bison roundup and culling operations begin. The hay must be on hand to feed captured animals and is required for the roundup to proceed; without it, the operation cannot happen. The urgent and compelling need arises from the fact that, without the roundup, herd numbers cannot be reduced, resulting in over-population and subsequent natural resource damage from over-grazing.
Roundups and culling are essential for managing herd size and maintaining ecological conditions, and the ongoing drought makes it even more critical to keep numbers within acceptable stocking levels.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:
Unlike conventional retail items that are sold at stable, preset prices, hay functions like other market-based commodities, their value fluctuates based on supply, demand, weather conditions, and regional availability.
