L. The Contractor must follow all DBW AIPCP procedures and comply with all environmental requirements for any work conducted (refer to the environmental permits for further details). Mechanical requirements include, but are not limited to the following:
a) The Contractor shall work with DBW Environmental Scientist to ensure implementation of a species survey protocol. The Environmental Scientist will check fish survey data to verify that listed fish species are not likely to be present at the removal site. If the fish surveys indicate that listed fish species are present in the area of mechanical harvesting, the Environmental Scientist will notify the Contractor to halt work immediately.
b) Mechanical removal of FAV in habitat for the federally and state-listed giant garter snake (GGS; Thamnophis gigas), or areas where GGS has been sighted in the past, will only be conducted outside of the May 1 to June 30 active GGS season, as per environmental permits.
c) The mechanical harvester will maintain a speed of 2 to 2.5 knots in areas outside of sensitive GGS habitat, or areas where GGS has been sighted in the past, during the active season, making it likely if GGS were to be in the area, they would be able to move out of the way.
d) Disturbance of upland giant garter snake habitat can only be conducted between May 1st and October 1st.
e) The Contractor will stop and/or reverse the mechanical harvester if a giant garter snake or listed fish species is seen within FAV during removal.
f) Notify USFWS, NMFS, and DBW immediately of the finding of any listed species or any unanticipated take or suspected take of listed species.
g) Dispose of all FAV collected by mechanical removal at an authorized disposal location.
h) Prior to each treatment season, DBW will conduct an environmental awareness training with all field crew members. DBW will also provide field crews with a special-status species guide for easy on-site identification.
Herbicide Treatments:
A. Herbicide treatments of FAV and/or SAV will occur only when DBW identifies a location in need of treatment.
Request for Proposals forRequest for Proposals for Division of Boating and Waterways
Aquatic Vegetation Control
B. Herbicide treatments will only occur to supplement treatments when DBW staffing is unavailable to accomplish the required work.
C. The Contractor shall coordinate work with the designated lead.
D. The Contractor shall initiate and carry out effective herbicide treatments in designated waterways within the Sacramento-San Joaquin Delta, Suisun Marsh, and its tributaries.
E. All herbicide treatments must be completed in sites within DBW’s jurisdiction.

G. The work shall consist of herbicide treatment of FAV and/or SAV using approved herbicides and equipment for effective treatments. The Contractor shall avoid treatment and damage of non-target plant species.
H. Prior to conducting herbicide treatment, the Contractor will utilize an Environmental Checklist to ensure that no listed species are within the project area. DBW may assist with identification of listed species and sensitive habitat. If listed species or sensitive habitats are present, the operator will not conduct herbicide treatments at that site without written approval from DBW staff.
I. The Contractor must follow all DBW AIPCP procedures and comply with all environmental requirements for any work conducted (refer to the environmental permits for further details). Herbicide treatment requirements include, but are not limited to the following:
a) Monitor dissolved oxygen levels pre- and post-treatment for all AIPCP treatments, and selected locations in the Delta over time.
b) Collect treatment data on Tablet or Datasheet provided by DBW
c) The Contractor shall work with DBW Environmental Scientist to ensure implementation of a species survey protocol. The Environmental Scientist will check fish survey data to verify that listed fish species are not likely to be present at the removal site. If the fish surveys indicate that listed fish species are present in the area, the Environmental Scientist will notify the Contractor to halt work immediately.
d) Provide a 100-foot buffer between boat spray treatments and shoreline elderberry shrubs.
e) For herbicide treatments within the 100-foot buffer around elderberry shrubs, crews will utilize backpack style spray wands to target herbicide directly onto FAV species.
f) Crews will only conduct herbicide treatments within the 100-foot buffer of elderberry shrubs when wind speeds are less than 3 mph.
g) Treatment crews will participate in training on herbicide and heat hazards, as well as continuing education units required under California Department of Pesticide Regulation.
h) Follow best management practices to minimize the risk of spill and to minimize the impact of a spill.
i) Boats will be maintained in good condition so that the engines are operating at optimal performance with no fluid leaks or discharges to the water.
j) Notify USFWS, NMFS and DBW immediately of the finding of any listed species or any unanticipated take or suspected take of listed species.

F. The work shall be carried out intermittently, as is needed, for all months of the year, except for May and June, based on previous Biological Opinions and other permit requirements.
G. Physical control actions will continue until the specified waterway is confirmed to be sufficiently clear of aquatic vegetation by DBW to allow vessel passage and navigation.
H. Prior to conducting physical control actions and/or equipment placements, the Contractor will utilize an Environmental Checklist to ensure that no listed species are within the project area. DBW may assist with identification of listed species and sensitive habitat. If listed species or sensitive habitats are present, the operator will not conduct herbicide treatments at that site without written approval from DBW staff.
I. The Contractor must follow all DBW AIPCP procedures and comply with all environmental requirements for any work conducted (refer to the environmental
Request for Proposals forRequest for Proposals for Division of Boating and Waterways
Aquatic Vegetation Control permits for further details). Physical control actions and equipment placement requirements include, but are not limited to the following:
