SUBJECT: Sole Source Justification for C22-004 Explosive Add-Ons
1. The 76th CMXG is requesting the utilization of funds for the purchase of Explosive Add-On parts to include delivery, installation, calibration, and performance verification in building 9001, Post E-14 at Tinker Air Force Base OK.
2. The Central Vacuum System located in building 9001, Post E-14 at Tinker Air Force Base is currently being installed by Air Cleaning Technologies. On December 29, 2020 a dust sample was sent off for testing per ASTM E1226. Dust explosibility results indicated that the tested sample showed material that may present an explosion and deflagration hazard risk when dispersed and ignited in air. Secondary explosions may also pose a risk once an initial explosion occurs with the presence of a combustible dust or powder in the area. Failure to upgrade this system could result in an explosion causing serious injuries and significant damage of property.
3. Air Cleaning Technologies has proprietary data rights to the design and operation of the Central Vacuum System that is currently being installed. This is a custom built system with specific modifications that were made prior to its deliver to Tinker AFB. Due to the ongoing installation of the system and the complexity of the current proprietary design, Air Cleaning Technologies is the only vendor capable of meeting the Government’s needs without change of form, fit, and function to the current proprietary design of the Central Vacuum System. Therefore, it is determined that Air Cleaning Technologies is the only vendor who can satisfy the Governments requirement.

4. Market Research was performed reviewing Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code (333413) looking for companies that could provide Explosive Add-On parts. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide Explosive Add-On parts. Air Cleaning Technologies, Inc. has proprietary data rights to the design and operation of the Central Vacuum System currently being installed. In review, Air Cleaning Technologies, Inc. is the only vendor capable of satisfying the Government’s requirement without change of form, fit, and function to the current proprietary design of the Central Vacuum System.
5. The Government will continue to monitor the market and conduct market research to find brands that are equivalent to and are compatible with existing equipment that is in use and that may be used as an alternative.
6. I have determined, in accordance with FAR 13.106-1(b) (1), that the circumstances of this contract action deem only a single source is reasonably available.
