About this file

This is Addendum #1 to RFP C15V0030 issued by the California Department of Parks and Recreation's Off-Highway Motor Vehicle Recreation Division for Certified Safety Training for Off Road Vehicles, dated April 21, 2016. The addendum clarifies requirements for ATV safety training organizations, specifically addressing the training requirements under California Vehicle Code (CVC) 38503 for minors and their supervisors. The document confirms that providers must be approved Off-Highway Vehicle Safety Education Committee Safety Training Organizations and meet specific standards for Youth ATV Safety Certificate Programs.

The addendum makes several key clarifications, including that Section 2.2 Project Deliverables replaces the previously referenced but missing Attachment 2 regarding training organization standards. It also specifies that ATV Safety Training Organizations must meet requirements in Section 11105.6 of the CVC for approval, and any subsequent revisions to standards would need to be mutually agreed upon to continue the awarded contract. The document clarifies that the SVIA, as a CA DMV licensed STO, would need to seek additional SEC approval for delivery of curricula items under their current STO license if awarded the contract.

Addendum #1

RFP C15V0030

Issue Date: April 21, 2016

REQUEST FOR PROPOSAL

For

Certified Safety Training for Off Road Vehicles

The changes in this Addendum shall be included in the Project and this Addendum shall be part of the Project documents. This Addendum addresses response submittal questions and correction regarding this request for proposal. All conditions not affected by this Addendum shall remain unchanged.

1. Question: Section 2.1.1 Training to be provided. SVIA understands that all items in

Section 2.1.1 with the exception of items G and I, relate to the training required under California Vehicle Code (CVC) 38503. Is that correct?

Answer: “Yes, with the exception of items G and I, all items in Section 2.1.1 relate to the required ATV safety training law for minors and those supervising them.”

2. Question: Section .1.1. F. Provider must be an approved Off-Highway Vehicle Safety Education Committee Safety Training Organization and meet the ‘Approved All-Terrain Vehicle Safety Training Organizations Standards for Youth ATV Safety Certificate Program’ requirements dated December 14, 2001 (attachment 2) or subsequent revision by mutual agreement. “

CVC 38500.1 lists the responsibility of the committee as determining if a potential Safety Training Organization (STO), based upon their submission to the committee, meets the minimum criteria as established by the Safety Education Committee (SEC) and, if approved, shall recommend the organization for licensing pursuant to Section 11105.6, by the CA Department of Motor Vehicles as an ATV Safety Training Organization. Is approval by the SEC sufficient or is an STO license by CA DMV required?

Answer: The ATV Safety Training Organization would need to meet the requirements in Section 11105.6 of the CVC to be an approved ATV Safety Training Organization.

Issue Date: April 21, 2016

3. Question: Section 2.1.1 F of the RFP references attachment 2.

But there does not appear to be an attachment 2 to the RFP. Does Section 2.2 Project Deliverables replace the missing attachment? If so, what are the implications if the standards change during the course of the contract?

Answer: Section 2.2 Project Deliverables is the replacement for the missing attachment 2. The subsequent ATV Safety Training Organization revisions to the standards would need to be agreed upon mutually.

4. Question: SVIA is a CA DMV licensed STO authorized to deliver an ATV Safety

Certificate Program listed within the California Vehicle Code (CVC) 38503. As such, we have sought and received approval from the SEC as meeting the curricula and minimum criteria for STOs.

If SVIA is awarded this contract, we would seek additional SEC approval for the delivery of curricula items included in this RFP under our current STO license. Can you clarify that a successful responder to this RFP would not be out of compliance based on a revision to the SEC requirements?

Answer: Section 2.1.1 F states that “Provider must be an approved Off-Highway Vehicle Safety Education Committee Safety Training Organization and meet the “Approved All-Terrain Vehicle Safety Training Organization Standards for Youth ATV Safety Certificate Program” requirement dated December 14, 2001 (attachment 2) or subsequent revision by mutual agreement. Subsequent ATV Safety Training Organization revisions to the standards would need to be mutually agreed upon and adjusted to continue the awarded contract.

5. Correction to Section 2.1.1 F of the RFP that references “Approved All-Terrain Vehicle Safety Training Organization Standards for Youth ATV Safety Certificate Program” is not separate attachment. The Standards are given in Section 2.2 Project Deliverables.
