MEMORANDUM

Subj: SOLE SOURCE MEMORANDUM TO PROCURE AND INSTALL A NEW

REVERSE OSMOSIS SYSTEM FOR NEDU’S CLASS 6 OXYGEN CLEAN ROOM

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price contract on a sole source basis to have Trumbull Bottled Water, Inc. (dba Culligan Water Conditioning of Panama City) supply Navy Experimental Diving Unit (NEDU) with an industrial grade reverse osmosis system to replace the obsolete system currently utilized by the Class 6 O2 clean room.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

Culligan Water Conditioning will provide NEDU with a new reverse osmosis system so NEDU can continue to execute our mission.

QTY DESCRIPTION

1 HE 1.5" Carbon Filter Single System - HE CF-14 - Gray 1 HE 1.5 DF 060 14inch Gray Softener with Brine Tank 375 lb Salt capacity 1 G2-6HE Reverse Osmosis System 1 Removal and Disposal of current system, Reinstall and start-up of new system

This acquisition will be conducted using simplified acquisition procedures with a total dollar value of less than $250,000. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

Culligan equipment is installed throughout NEDU’s Class 6 Clean Room and Culligan currently services all the equipment. This equipment is utilized to create Grade B water for the cleaning of diving and life support equipment in high pressure pure O2 environments to contaminate levels of < 5 parts per million (ppm). The Culligan systems are the only approved systems for NEDU through NEDU’s certification authority.

Therefore, alternative products would require extensive testing, verification, and re-certification.

As such, the government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to Culligan Water Conditioning the reverse osmosis system purchase order.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Culligan Water Conditioning is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov because it is estimated greater than $25,000.00.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Culligan Water Conditioning is the only company that can provide the equipment, installation, certificates of compliance (CoC), and objective quality evidence (OQE) as required to maintain certification. Other reverse osmosis systems would require a complete recertification of NEDU’s Clean Room.
