About this file
This is a Brand Name Justification document for the Naval Surface Warfare Center Panama City Division (NSWC-PCD) to procure specific laser equipment from RPMC Lasers, Inc. The acquisition involves a firm fixed-price contract for six line items, including a Compact Nanosecond Laser (WEDGE HF 532nm Plus), a microprocessor-based control box, low jitter configuration, power supply, pick-off monitor, and shipping. The total quantity is one of each item, with the laser configured for 100-200kHz operation and 532nm wavelength. The procurement is being conducted using simplified acquisition procedures, with justification based on the need to upgrade an existing prototype and eliminate risks associated with changing brands, such as potential hardware incompatibility and system redesign.
The document emphasizes that RPMC Lasers, Inc. is the only brand that can meet the government's needs, citing form/fit/function upgrade requirements and the potential for unacceptable project delays if another manufacturer is selected. The Contracting Officer has determined that this order represents the best value, considering factors like price, special features, and administrative costs. The requirement will be synopsized on sam.gov, and the acquisition is specifically for the Naval Surface Warfare Center Panama City Division, located at 110 Vernon Ave., Panama City, FL 32407.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the items listed in Paragraph 3 of this document. This brand laser is currently in use in an existing prototype and the project is looking to upgrade the laser. The items in
Paragraph 3 are a form/fit/function upgrade. Also, by procuring the same brand laser, the risk of incompatible components is eliminated. If another brand were selected, the risk of hardware incompatibility is introduced as well as the potential need for a system redesign as it would not be a form/fit/function swap, both introducing unacceptable risk of project costs and delay.
As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.
Therefore, it is in the Governments’ best interest to acquire the RPMC Lasers, Inc. brand.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, RPMC Lasers, Inc. is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, RPMC Lasers, Inc. is the only brand that can meet this requirement.
