About this file

This is a Brand Name Justification document for a limited source procurement by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD). The justification authorizes a firm fixed price order on a brand name specific basis to acquire 90 SubConn Connector units, part number FCR2012M, from an authorized SubConn reseller. The total dollar value exceeds micro-purchase levels but does not exceed the simplified acquisition threshold.

The contracting officer determined that SubConn is the only brand of equipment meeting the government's needs because SubConn connectors are the original equipment manufacturer (OEM) brand connectors for the MK 68 system, and the Interface Design Document for the CDM system specifically requires SubConn Connector brand with no alternatives. The justification cites that procurement of any other brand product would result in compatibility issues with existing systems. The contracting officer has determined the order represents best value and results in the lowest overall cost alternative. No additional market research was conducted beyond the technical requirements analysis, as SubConn is the sole source capable of meeting the requirement. The document references FAR 6.302-1(a)(2)(iii)(C) authority for sole source procurement based on unique compatibility requirements.

This is a brand name justification. Contracting activity is

Naval Sea Systems Command Naval Surface Warfare Center Panama City Division (NSWC PCD) 110 Vernon Avenue, Panama City, FL 32407-7001 Contracts Department

2. Nature and/or description of the action being approved.

This action will award a firm fixed price order on a brand name specific basis to the lowest price offeror that is an authorized reseller of SubConn brand products.

3. A description of the supplies or services required to meet the agency’s needs

(including the estimated value).

The contract effort is to acquire:

Line No.

Item Part Number Qty

1 SubConn Connector FCR2012M 90

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold. Redacted.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(C).

Pursuant to FAR 6.302-1(a)(2)(iii(C), SubConn is the only brand of equipment that will meet the Government’s needs for the following reasons. The SubConn brand connectors are OEM brand connectors for the MK 68. Also, the Interface Design Document for the CDM system requires the use of the Subconn Connector brand and no other. If any other brand product were procured, it could result in compatibility issues with existing systems. This specific manufacturer’s product is fully compatible with the current system being supported. Therefore, it is imperative that the brand procured is SubConn.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Redacted. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than SubConn to provide the products.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, SubConn is the only brand that can meet this requirement.
