About this file

This document is a Brand Name Justification for the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) to procure a Rohde & Schwarz brand pulse power sensor and USB power sensor cable.

The justification states that Rohde & Schwarz is the only brand that meets the government's needs, as the required equipment must be compatible with Linux-based support laptops used by the Multi-Vehicle Communications System group. The Contracting Officer has determined this purchase order represents the best value to meet the government's requirements. The total estimated value is above the micro-purchase threshold but below the simplified acquisition threshold. The procurement will be conducted as a small business set-aside, with quotes due by April 15, 2024 at 11am Central Time. Subj: BRAND NAME JUSTIFICATION TO PROCURE ROHDE & SCHWARZ SENSOR

AND CABLE.

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, on a brand specific basis, for the acquisition of a Rohde & Schwarz brand pulse power system. Competition will be limited to authorized distributors and re-sellers of the Rohde & Schwarz items listed in Paragraph 3.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated).

Line Description Qty.

1 NRPxxP Power Sensor

The aforementioned line item consists of the following:

NRP18P

Pulse power sensor, 50MHz to 18GHz; 1nW to 100mW, N(m) 30MHz video bandwidth, USB sensor cable R&S®NRP-ZKU or power sensor cable R&S®NRP-ZK6 required (accessory)

NRP-ZKU

USB power sensor cable (1.5m), for NRPxxS/T/A/SN/TN/AN sensor operation with a Laptop/PC; powered via USB, connectors: M12(sensor side) - USB A (accessory)

This acquisition will be conducted using simplified acquisition procedures. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).

Rohde & Schwarz brand equipment is the only equipment that will meet the Government’s needs for the following reasons. The Multi-Vehicle Communications System (MVCS) group uses Linux-based support laptops. Most RF power sensors in the market are only compatible with Windows-based computers. Rohde & Schwarz RF power sensors are not only Windows and Linux compatible, but are also the only brand of RF power sensors that have been verified as fully compatible with MVCS support laptops.

As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.

Therefore, it is in the Governments’ best interest to acquire the Rohde & Schwarz brand.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Rohde & Schwarz is the only brand that can meet the Government’s needs.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Rohde & Schwarz is the only brand that can meet this requirement.
