About this file
This brand name justification document seeks approval to procure two Patriot 3 brand JetBoots V5 50AH diver propulsion systems and associated equipment and services from authorized Patriot 3 distributors and resellers on a sole source basis. The Naval Sea Systems Command, Naval Surface Warfare Center Panama City Division requires these systems to upgrade their Diver Integrated Modular System of Systems propulsion capabilities to meet new performance requirements identified by the Office of Naval Research. The JetBoots V5 50AH system is described as the only brand that can satisfy the low-noise, lithium-ion battery powered propulsion needs for combat swimming operations including reconnaissance, search and rescue, patrol, and hull inspections. A market survey found no other brand capable of meeting requirements while maintaining the current system integration and avoiding project delays.

This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
The PATRIOT 3 brand JetBoots is the only brand of diver propulsion system that will meet the Government’s needs for the following reasons. JetBoots uses low noise brushless motors and Lithium-Ion Batteries to achieve powerful propulsion at very low total system weight that is used with fully geared combat swimmers. Reconnaissance, search and rescue, patrol, and hull inspections are just some of the uses of JetBoots. The JetBoots system is an Approved for Navy Use (ANU) system that has been approved by the U.S. Department of Defense and is compatible with standard issue military dive gear.
The Diver Integrated Modular System of Systems (DIMSS) project at NSWC PCD utilizes the JetBoots propulsion systems to meet their current performance requirements. The project has been tasked by the program office, Office of Naval Research (ONR), to upgrade the propulsion system to meet new performance requirements. The new design generation, V5, of the JetBoots system has demonstrated to be capable of meeting this requirement with minimal impact on the current DIMSS system integration. In addition, the current DIMSS systems is fleet supported and maintaining the configuration is essential to avoid impact on project transition.
As such, the Government does not expect significant savings through testing and qualifying alternate equipment and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to acquire the PATRIOT 3 brand Jet Boot diver propulsion system is acquired.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, PATRIOT 3 is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, PATRIOT 3 is the only brand that can meet this requirement.
