About this file
This document is a brand name justification memorandum for the acquisition of Nuvair electronic boards with sensors from Nuvair. The Naval Sea Systems Command, Naval Surface Warfare Center Panama City Division requires 75 electronic boards with sensors initially, with options to acquire up to an additional 100 boards. The boards are needed for the manufacture and overhaul of carbon monoxide monitor assemblies for NAVSUP. Only Nuvair brand parts can meet the requirements due to being the only sensor that alarms at the required level and fits within the design envelope. Extensive market research and testing has shown Nuvair to be the only brand suitable. The related federal contract opportunity is a small business set aside solicitation for the Nuvair electronic boards with sensors as described in the attachments.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) (1) - Only one responsible source and noother supplies or services will satisfy agency requirements, FAR 6.302-1.
Only Nuvair brand parts can meet Government needs for the following reasons. The Carbon Monoxide (CO) Monitor was developed and designed to meet CFR requirements for portable breathing air compressors. The sensor from Nuvair was found after extensive market research for a sensor that would alarm at the required reading and fit within the envelop needed for our design. Use of alternate equipment may introduce new or change existing parameters that may be harmful to the compressors, therefore, Nuvair is the only brand that will meet the requirements for this effort. Nuvair electronics boards with sensor have been tested and fit within our design. A sensor from another brand would require extensive testing and incur added expense and time.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1.
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
As stated in paragraph 4 above, Nuvair is the only brand that can meet the Government’s requirements
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Nuvair is the only brand that can meet the Government’s requirements.
