About this file
This document is a limited source justification from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division to procure add-ons for the BIOPAC Systems brand of data acquisition equipment. The agency requires the following items from BIOPAC Systems authorized resellers: a CO2 Measurement Module, Oxygen Measurement Module, two Differential Amplifier Modules, two Pneumotach Transducers, a Differential Transducer, Gas Sampling Interface Kit, and filters. This purchase is justified as the BIOPAC Systems brand is currently used as the primary data system for physiology research at the agency. Maintaining consistency with the existing BIOPAC Systems equipment will reduce training costs and complexity while allowing current peripherals to remain interchangeable. Competition among all schedule holders is not expected to result in significant savings beyond authorized BIOPAC resellers due to unacceptable delays impacting the research requirements. The contracting officer determined this purchase from a BIOPAC Systems reseller presents the best value solution.

Subj: BRAND NAME JUSTIFICATION TO PROCURE BIOPAC SYSTEMS ADD-ONS
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a limited source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order, on a brand name basis, to acquire the BIOPAC brand data acquisition equipment to support NEDU warfighter and human performance research. Competition will be limited to authorized resellers of BIOPAC.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated).
The Vendor shall supply the following items:
Description Qty. Item #
CO2 Measurement Module 1 CO2100C
Oxygen Measurement Module, C‐Ser 1 O2100C
Pneumotach Transducer 2 TSD107B
Differential Amplifier Module, C‐Series 2 DA100C
Differential Transducer 75 cm H2O 1 TSD160D
Gas Sampling Interface Kit 2 AFT20
Hydrophobic filter 10 pk 1 RX‐AFT‐20‐filter
Nafion drying tube 10 pk 1 RX‐AFT20‐NAFION
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
The BIOPAC Systems add-ons requested on this order are required to complete tasked warfighter and human performance research at NEDU. This brand is currently being used as the primary data-acquisition system for physiology research of this type and by purchasing these add-ons, the Government is able to maintain consistency, reduce training costs, and reduces system complexity. Furthermore, by expanding the capabilities of the BIOPAC Systems currently in use, the current supporting peripherals will be interchangeable, thus saving the Government money.
As such, the Government does not expect significant savings through competition, outside of the authorized resellers of BIOPAC, and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to acquire the BIOPAC Systems brand.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, BIOPAC Systems is the only brand that can meet the Government’s needs. This requirement will not be synopsized in the government point of entry per FAR Exception 5.202(a)(11).
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, BIOPAC Systems is the only brand that can meet this requirement.
