About this file
This document is a brand name justification memorandum to acquire four TDK-Lambda Inc. Z20-40-U programmable power supplies from TDK-Lambda Americas Inc. on a sole source basis. The Naval Sea Systems Command, Naval Surface Warfare Center Panama City Division requires the power supplies for use in the Navy Experimental Diving Unit's Ocean Simulation Facility to power diver-worn heated garments. The justification cites that TDK-Lambda is the only brand that can meet requirements because NEDU owns multiple TDK-Lambda programmable power supplies already integrated and validated to function with the heated garments and existing software interfaces. Significant additional delays and costs would be incurred if an alternative brand was considered. The related federal contract opportunity is a small business set-aside solicitation for the TDK-Lambda brand power supplies in accordance with the justification memorandum.

Subj: BRAND NAME MEMORANDUM TO ACQUIRE FOUR (4) EACH TDK-LAMBDA
INC., Z20-40-U PROGRAMMABLE POWER SUPPLIES
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”
This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.
2. Nature and/or description of the action being approved.
This action will award a purchase order, on a brand name specific basis, to acquire four (4) each TDK-Lambda Americas Inc., Model Z20-40-U programmable power supplies for use within NEDU’s Ocean Simulation Facility (OSF) Facilities to power diver-worn heated garments.
3. A description of the supplies or services required to meet the agency’s needs.
(including the estimated value). The contract effort is to acquire the following:
Item Part
Number Qty
AC/DC Programmable Power Supply, 0-36V Z20-40-U 4
The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).
The TDK-Lambda Americas Incorporate power supply units are the only brand of equipment that can meet the Navy’s needs for the reasons.
1) The Navy Experimental Diving Unit (NEDU) owns multiple lower and higher output wattage version of TDK-Lambda Americas Incorporated, programmable power supplies and this modernization procurement is to maintain all current communication protocols but to allow for more current draw.
2) NEDU owns multiple TDK-Lambda programmable power supplies that is specifically designed to work with the stated heated garments being tested at NEDU, these specified items have been validated to function with the current version of software changes and external sensors.
3) NEDU already spent many years building up the interfaces for this specific brand adapting it for every research study possible. TDK-Lambda is the only brand to meet the requirement, as any alternative will mean that a new user interface will have to be built, which will cause significant delays in our project schedule forcing these projects to needlessly miss their completion date.
In summary, the impact on the fleet mission is if TDK-Lambda brand equipment is not purchased that NEDU will experience a deficiency in their ability to support the U.S. Navy. A significant investment has been made in the existing interfaces of the TDK-Lambda programmable power supplies. Therefore, it is imperative that the TDK-Lambda Americas Inc.
brand programmable power supplies are acquired.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, TDK-Lambda Americas Inc. is the only brand of equipment that can meet the Government’s needs.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, TDK-Lambda Americas Incorporated is the only brand of equipment that can meet the Government’s needs.
