About this file
This document is a Brand Name Justification for the acquisition of a 16-Port Transceiver Test System from manufacturer JFW. The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division requires this equipment for its Multiple Vehicle Communications System (MVCS) project. The justification cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1(c) as the rationale for the brand name procurement, stating that the JFW equipment is the only product that meets the government's technical requirements and is compatible with existing MVCS communications testing needs. The contracting officer has determined this order represents the best value and lowest overall cost alternative to meet the government's needs. The associated federal contract opportunity solicits quotes for the 16-Port Transceiver Test System, with quotes due by July 24, 2024. The procurement will be conducted using simplified acquisition procedures.

Line
Description
Qty.

50PMA-055 N
16 Port Transceiver Test System 30-3000 MHz 0-95X1
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) (1) - Application for brand name description FAR 6.302-1(c).
The NSWC PCD Modular Integration Division, Distributed Integration Branch (A33) Multiple Vehicle Communications System (MVCS) project has a need for lab testing and data analysis equipment. Through equipment analysis, market research, and discussions with hardware vendors, the JFW equipment specified in paragraph 3 was determined to be the equipment that is the most suitable replacement for the Vertex Channel Emulator and the RF Management System, as it is compatible with MVCS communications testing requirements. The JFW equipment specified in paragraph 3 also came highly recommended by other Warfare Center groups that specialize in communications testing. If another brand were to be selected, additional equipment, software reconfiguration, and engineering expert labor hours would be required, resulting in project delay and cost over-runs.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(a).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, JFW is the only brand that can meet the Government’s needs. This requirement is not exempt from synopsis and will be made available through the government point of entry, Sam.gov.
7. Any other facts supporting the justification:
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, JFW brand is the only company that can meet the requirement.
