About this file
This document is a Brand Name Justification for the Naval Surface Warfare Center Panama City Division (NSWC PCD) to procure specific Premier Industries brand shutoff valves for the Wave Dancer Project. The procurement involves four Valve-Shut Off Angled Configuration units (Manufacture # 70-1200A-ST2V-02) and four Premier5033 Series Vespel Sp-1 Seats (Manufacture # 30-10819-321-4223), which are critical for testing the life support system's operator safety. The acquisition will be conducted using simplified acquisition procedures, with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold, and all equipment will be delivered within 6 weeks after order award.
The justification emphasizes that only Premier Industries valves can ensure proper sealing of 37-degree flare fittings and control fluid flow for the pressurized test system. The Contracting Officer has determined the order represents the best value and lowest overall cost alternative, citing potential risks of decertification and system parameter changes if alternative components are used. The requirement will be synopsized on sam.gov, and competition will be limited to authorized distributors of Premier Industries brand equipment, with the procurement authorized under 10 U.S.C. 2304(c)(1) and FAR 6.302-1(c).

10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
The Naval Surface Warfare Center Panama City Division (NSWC PCD) Wave Dancer project has an immediate need for the Valve-Shut Off Angled Configuration & Premier 5033 Series Vessel Sp-1 Seat listed in Section 3 of this document to support project testing efforts. These are the only valves that can ensure proper sealing of 37-degree flare fittings and control the fluid flow for pressurized test system. Only successfully tested articles are qualified for use with the Dancer Project. The objective of this process is to verify that the life support system provides acceptable levels of operator safety throughout the specified operating range. Premier is a global developer and provider of high-quality and reliable fluid system solutions including products, assemblies and services for the research, instrumentation, process, oil and gas, power, petrochemical, alternative fuels, and semiconductor industries. Using alternate equipment would prove costly in time and dollars to the Government and to the mission through possible decertification of the Wave Dancer Project. Additionally, use of alternative components may change or introduce new parameters that may be harmful to the user of the Wave Dancer system. Therefore, it is imperative that the Premier brand of equipment is purchased.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Premier Industries is the only brand that can meet the Government’s needs. Additionally, this requirement will be synopsized in the government point of entry sam.gov. REDACTED.
7. Any other facts supporting the justification.
None.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Premier Industries is the only brand that can meet this requirement.
