About this file
This memorandum provides a brand name justification to acquire 10 units of High Tech Inc.'s Hydrophone/Titanium Hex Differential Preamp on a 24-inch pigtail. The Naval Sea Systems Command, Naval Surface Warfare Center Panama City Division requires this specific product to measure and record acoustic data within the required frequency range of 2Hz to 50 kHz for use in its Mission Processor Assembly and NAVITTAR Mk-61, 62, and 63 mine countermeasure systems. Only this particular hydrophone sensor, which has undergone acoustic testing at NSWC PCD, can match the necessary signal, power levels, and frequency response without additional testing and costs. The contracting officer determined this action represents the best value solution. The justification is for a small business set-aside solicitation from the Department of the Navy for these 10 units of the High Tech Inc. hydrophone.

MEMORANDUM
Subj: BRAND NAME JUSTIFICATION TO ACQUIRE HYDROPHONE/TITANIUM HEX Differential Preamp on 24" pigtail
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”
This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Division Code 02).
2. Nature and/or description of the action being approved.
This action will award a purchase order, on a brand name specific basis, to acquire Hydrophone/Titanium Hex Differential Preamp on 24" pigtail.
3. A description of the supplies or services required to meet the agency’s needs

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00.
4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.
Only the High Tech, Inc P/N: HTI-92-WB-HEX will meet the Government’s requirements for the Mission Processor Assembly’s ability to measure and record data from the acoustic influence sensor functions in the required frequency response. This sensor provides a unique differential amplifier that is required to match our Mission Processor Assembly signal and power levels along with a unique frequency response in the range from 2Hz to 50 kHz. This hydrophone has undergone acoustic characterization and calibration testing at the NSWC PCD acoustic test barge as a stand-alone sensor and for the NAVITTAR Mk-61, 62, and 63 systems. Use of an alternate sensor would require additional testing time and money to characterize and calibrate for the MCM Targets.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
The dollar amount of this procurement does not require a synopsis. The program was unable to find other commercially available modems capable of being integrated into a housing or enclosure that operated at the required frequency to enable reuse of existing acoustic transducers.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, only the HTI-92-WB will meet the Government’s requirements.
