About this file

This FAR Subpart 8.4 Limited Sources Justification document details the United States Marine Corps' intent to issue a sole source order for nineteen (19) CyberFEDS Web Subscription licenses and one (1) Worker's Compensation Subscription from LRP Publications, Inc. The procurement is for the Civilian Workforce Management Branch, with a required delivery start date of 01 April 2025, covering one base period and four option periods. The sole source justification is based on CyberFEDS being the only platform offering a unique combination of federal employment law resources, including exclusive access to Broida's and Hadley's Guides, over 350 Quick Start Guides, tailored eLearning courses, and comprehensive legal and HR compliance tools specifically designed for federal agencies.

The total estimated value includes a base year and four option years, to be funded through Marine Corps Operations and Maintenance (O&M) appropriations. The order will be placed under GSA Schedule Contract No. 47QTCA20D002P, with justification citing the platform's proprietary nature, specialized capabilities, and inability of other vendors to meet the Marine Corps' specific requirements for legal research, HR management, and workforce development resources. The procurement is being conducted by the Marine Corps Installations National Capital Region - Regional Contracting Office, with the intent to ensure continued access to critical information supporting the Marine Corps' mission and readiness.

V. THE DETERMINATION TO LIMIT SOURCES IS BASED ON THE FOLLOWING AUTHORITY AND

SUPPORTING RATIONALE (select all that apply):

A. ___ AN URGENT AND COMPELLING NEED EXISTS, AND FOLLOWING THE PROCEDURES

IN FAR 8.405-2 OR 8.405-3 WOULD RESULT IN UNACCEPTABLE DELAYS (FAR 8.405-

6(a)(1)(i)(A)):

The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

4. Market research:

B. X ONLY ONE SOURCE IS CAPABLE OF PROVIDING THE SUPPLIES OR SERVICES

REQUIRED AT THE LEVEL OF QUALITY REQUIRED BECAUSE THE SUPPLIES OR SERVICES

ARE UNIQUE OR HIGHLY SPECIALIZED (FAR 8.405-6(a)(1)(i)(B)) (select all that apply):

1. X RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required. 2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the

Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. X OTHER REASONS.

Authority Permitting Limiting Sources:

Pursuant to FAR subpart 8.405-6(a)(1)(i)(B), only one source is capable of providing the supplies at the level of quality required because the supplies are unique or highly specialized. The LexisNexis software is proprietary; therefore, no other vendor can provide the installation, implementation services, training, maintenance and/or help desk support. The LexisNexis software along with the accompanying IT Professional Services and Training is essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet, or cannot be modified to meet, the agency’s needs.

In addition, this document meets the regulatory authority to execute the justification and approval addressed at FAR 13.5.

Rationale Justifying Use of Cited Authority:

The government uses CyberFEDS for several reasons, given its extensive capabilities and the unique needs of the government operations in the realm of government law and human resource management:
