About this file

This is a Brand Name Justification Memorandum for a limited source procurement by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD).

The Government seeks to acquire one Seacraft TAC2000 Complete Set and associated shipping on a firm fixed price purchase order basis for an estimated total contract value above micro-purchase levels but not exceeding $350,000. The equipment will be used to support various diving and maritime missions. All repaired equipment must be delivered within ninety days of receipt. The justification for sole source procurement to DPV-Tech Inc is based on the fact that DPV-Tech is the original equipment manufacturer (OEM) of the Seacraft systems, has not authorized use of any other vendor's parts for repairs or maintenance, and all systems are proprietary to DPV-Tech Inc. The contracting officer has determined that acquiring DPV-Tech brand components represents the best value and lowest overall cost alternative, as substitution with other vendors' components presents operational risk and would not generate significant competitive savings. No market research was conducted among schedule holders due to the unique, proprietary nature of the required equipment and the single responsible source determination under 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2)(iii)(B).

MEMORANDUM

Subj: BRAND NAME MEMORANDUM TO ACQUIRE SEACRAFT TAC2000 BRAND DIVER

PROPULSION SYSTEM

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source” Justification.

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, on a brand name basis, to acquire DPV-TECH brand Seacraft TAC200 Diver Propulsion Vehicle (DPV). The DPVs will be used to support various diving and maritime missions.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated).

The contract effort is to acquire the following:

Description Qty

Seacraft TAC2000 Complete Set 1 Lot

Shipping 1 Lot

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $350,000.00. All repaired equipment will be delivered no later than ninety (90) days after receipt from the Government.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C.

2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).

DPV-Tech is the only brand of DPV that will meet the Government’s needs for the following reasons. DPV-Tech Inc is the original equipment manufacturer (OEM) for the Seacraft systems. The OEM has not authorized the use of any other vendor or manufacturer’s parts to make repairs or conduct maintenance. The Seacraft systems are all proprietary to DPV-Tech Inc. If another vendor were to be selected, there is a risk of sub-par components being substituted in place of the DPV-Tech Inc OEM components, which may be detrimental to the operation of the DPV.

As such, the government does not expect significant savings through competition, and it is more advantageous to the Government to acquire DPV-Tech Inc brand system components and systems for the procurement of the material listed in Paragraph 3 of this document.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, DPV-Tech Inc is the only brand that can meet the Government’s needs.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, DPV-Tech Inc is the only brand that can meet this requirement.
