About this file

This is a Brand Name Justification memorandum for a firm fixed price purchase order issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), located at 110 Vernon Avenue, Panama City, FL 32407-7001.

The acquisition seeks to procure SUEX NERO2 Diver Propulsion Vehicle (DPV) accessories, spares, and transport equipment through simplified acquisition procedures with a total dollar value not exceeding $350,000.00. The required items include one SUEX DPD NERO 2 OBB PA6 system, two aluminum transport boxes for NERO2, one aluminum transport box frame (SX2023 STD Design 72007), two offboard battery pods, one OBB mount assembly, two male-male cable assemblies, two male-male cable subconnectors, two spare NERO1 Li-Ion batteries, two SUEX NERO C-1-2 36V Li-Ion chargers, one Pelican 1780 case with foam inserts, and shipping. All repaired equipment must be delivered no later than ninety (90) days after receipt from the Government. Competition is limited to authorized distributors and resellers of SUEX brand equipment. The justification cites FAR 6.103-1(d) to support the brand name restriction, asserting that SUEX is the only DPV brand meeting the Government's needs due to the critical nature of military operations requiring stealth, autonomy, and reliability, with interoperability and operator safety dependent on original SUEX components. The Contracting Officer will determine prior to award that the order represents best value considering technical factors, price, and past performance.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $350,000.00. All repaired equipment will be delivered no later than ninety (90) days after receipt from the Government.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. Authority: FAR 6.103-1(d), Application for brand-name descriptions.

Pursuant to FAR 6.103(d), SUEX is the only brand of DPD that will meet the Government’s needs for the following reasons. The SUEX NERO series is a professional and military-grade line of diver propulsion vehicles (DPVs).

These underwater propulsion vehicles are designed for military operations and state security forces, where stealth, autonomy, and reliability are determining factors. Due to the critical nature of these operations, it is imperative that all accessories, spares, and transport equipment are strictly manufactured by or authorized by SUEX. Using aftermarket, generic, or unverified alternative parts could lead to equipment failure, thereby compromising mission stealth, operational autonomy, and the overall safety of the operators. Only original SUEX components are guaranteed to integrate flawlessly with the existing NERO2 DPV platforms currently in use. In summary, to ensure interoperability, operator safety, and mission readiness with currently fielded maritime mobility assets, alternative DPV platforms cannot be substituted. Competition will be limited to authorized distributors and resellers of SUEX brand equipment to ensure all OEM warranties, maintenance standards, and operational specifications are maintained.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.203.

Prior to award, the Contracting Officer will determine that the resulting order represents the best value and results in the lowest overall cost alternative (considering technical, price, and past performance) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, SUEX is the only brand of diver propulsion device that will meet the Government’s needs.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

For the reasons specified in paragraph 4 above, SUEX is the only brand of diver propulsion device that will meet the Government’s needs.
