About this file
This is a Brand Name Justification document submitted by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) to acquire Lawrence Factor brand filter parts on a restricted basis.
The Government is acquiring two items for the High-Pressure Filter Assembly (HPFA), which is part of the Breathing Air Charging System (BACS) used to charge Self-Contained Breathing Apparatus (SCBA) cylinders with Grade D breathing air to 4500 pounds per square inch. The required items are 30 Cart Holders (part number PUR-002-AG) and 17 Coalescors (part number PUP-020-AG). The total acquisition value exceeds micro-purchase levels but does not exceed the simplified acquisition threshold. The justification asserts that Lawrence Factor is the only brand meeting Government requirements because the HPFA system was specifically designed, built, and outfitted with these Lawrence Factor components, and use of alternate equipment would introduce unacceptable operational risk and harmful parameter changes. As the original equipment manufacturer (OEM), Lawrence Factor parts are specific to the HPFA build for the fleet. The Government does not anticipate significant cost savings from qualifying alternate brands and expects significant, unacceptable delays that would negatively impact the requirement. Prior to award, the Contracting Officer will determine that the resulting order represents best value and the lowest overall cost alternative considering technical, price, and past performance factors. Market research was not conducted for the reasons specified in the justification that Lawrence Factor is the sole brand capable of meeting requirements.

Subj: BRAND NAME JUSTIFICATION TO ACQUIRE LAWRENCE FACTOR FILTER PARTS FOR
THE HIGH PRESSURE FILTER ASSEMBLY (HPFA)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”
This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.
2. Nature and/or description of the action being approved.
This action will award a purchase order, on a brand name specific basis, to acquire Lawrence Factor brand parts for the High-Pressure Filter Assemblies (HPFAs). The HPFA is part of the ships Breathing Air Charging System (BACS). The BACS is used to charge SCBA cylinders with breathing quality air (Grade D) to a pressure of 4500 pounds per square inch. The HPFA provides Grade D breathing air for use in filling SCBA cylinders. These components are technical machined and manufactured parts.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The following items are being acquired:
Item Part Number Qty
Cart, Holder PUR-002-AG 30
Coalescor PUP-020-AG 17
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. Authority: FAR 6.103-1(d), Application for brand-name descriptions.
Pursuant to FAR 6.103-1(d), Lawrence Factor is the only brand of filters that will meet the Government’s needs for the following reasons. The High-Pressure Filter Assembly (HPFA) is used for Self-Contained Breathing Apparatus (SCBA) charging of cylinders with Grade D air. The cartridge towers and coalescor used in this system are manufactured by Lawrence Factor and when building these systems, only the Lawrence Filter brand of parts can be used. The system was designed, built and outfitted with these specific parts. Use of alternate equipment may introduce new or changing existing parameters that introduce unacceptable risk may be harmful to the proper operation of the equipment. Therefore, Lawrence Factor is the only brand that will meet the requirements for this effort. Lawrence Factor is the OEM and these parts are specific to the build of HPFAs for the fleet.
As such, the Government does not expect significant savings through qualifying an alternate brand and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to acquire the Lawrence Factor brand filters.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 12.203.
Prior to award, the Contracting Officer will determine that the resulting order represents the best value and results in the lowest overall cost alternative (considering technical, price, and past performance) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For the reasons specified in paragraph 4 above, Lawrence Factor is the only brand of equipment that will meet Government requirements.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, the Lawrence Factor brand is the only brand that can meet this requirement.
