About this file

This is a Brand Name Justification Memorandum for a firm fixed price purchase order to acquire an Accurpress Accell E 41258 press brake system and associated components through simplified acquisition procedures. The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) is the contracting activity located in Panama City, Florida.

The procurement includes one Accurpress Accell E 41258 unit with integrated Vision Control, Elite 6 Axis Back Gauge CNC, 3D Vision Control Upgrade with SolidWorks/Inventor compatibility, Wila hydraulic clamping and CNC crowning systems, T-slot machining, electrical configuration at 460VAC/60HZ/3PH, pre-filtered hydraulic oil, front support arms, and multiple supporting components (Items 20, 30, 40, 70, and 80). Installation, training, 24-month parts warranty, and 12-month labor warranty are included. The justification for brand-specific acquisition is based on NSWC PCD's existing Accurpress system infrastructure, compatibility of interchangeable components, extensive tooling inventory designed for Accurpress equipment, personnel familiarity with Accurpress software and procedures, and Accurpress's established nationwide service and maintenance network with local facilities in proximity to the installation. The contracting officer has determined this acquisition represents the best value and lowest overall cost alternative. The requirement will be synopsized on sam.gov. No market research was conducted among alternative manufacturers due to the unique compatibility and operational requirements specific to the existing Accurpress system.

This acquisition will be conducted using simplified acquisition procedures. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.

This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service. Authority: FAR 6.103-1(d), Application for brand-name descriptions.

The Naval Surface Warfare Center Panama City Division (NSWC PCD) has an existing Accurpress system, and introducing a different brand would require the government to incur duplicative costs, cause compatibility issues and system integration delays.

Components on the existing system are interchangeable with the system listed in Paragraph 3. NSWC PCD currently utilizes an extensive inventory of tooling specifically designed, calibrated, and proven for Accurpress equipment. Procuring a different brand would necessitate the costly and time-consuming replacement of this fully functional tooling inventory. By purchasing the Accurpress, and not another brand, the Government can utilize currently owned tooling in combination with this new system, thus saving the Government money by avoiding duplicative costs and reducing sparing/logistics requirements. NSWC PCD personnel are familiar with Accurpress software, operation and maintenance procedures. To use another manufacturer to purchase new equipment might compromise overall performance by introducing new parameters in programming, operation and maintenance. Standardizing on Accurpress ensures immediate interoperability, eliminates the need for extensive operator retraining on a new control system, and prevents critical delays in fabrication.

Accurpress maintains an extensive service, maintenance, and repair network throughout the continental United States with locations in immediate proximity to the NSWC PCD installation.

This localized presence guarantees rapid response times for technical troubleshooting and emergency repairs. Because minimizing machine downtime is critical to maintaining mission readiness and production schedules, alternative brands that lack an established local footprint pose an unacceptable risk to operational availability. Accurpress provides hands-on training at its Atlanta, GA and Tampa, FL facilities, ensuring personnel turnover does not pose a risk for unqualified machine operation at NSWC PCD.

As such, the Government does not expect significant savings through purchasing alternate brands and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to acquire the Accurpress brand.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with

FAR 12.203.

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Accurpress is the only brand that can meet the Government’s needs. This requirement will be synopsized in the government point of entry sam.gov.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the Accurpress brand is the only product that can meet the requirement.
