About this file

This is a Brand Name Memorandum (Limited Source Justification) for a federal procurement action. The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) seeks to acquire two Snap-On Tool Kits (Part Number TFPQ-54039-02) via firm fixed price purchase order on a brand name basis. The acquisition will be conducted using simplified acquisition procedures with a total dollar value exceeding micro-purchase levels but not exceeding the simplified acquisition threshold. Competition is limited to authorized resellers of Snap-On Tools products.

The justification establishes that Snap-On is the only brand capable of meeting the Government's specific needs for maintenance, repair, and overhaul (MRO) of Unmanned Systems, including Unmanned Aerial Vehicles (UAVs), Unmanned Ground Vehicles (UGVs), and Unmanned Undersea Vehicles (UUVs), as well as the LCAC system. The memorandum cites technical compatibility with existing U.S. Unmanned Systems equipment, precise dimensional requirements, interface specifications, and air leakage requirements that only Snap-On tools satisfy. The Contracting Officer determined the acquisition represents best value and lowest overall cost alternative, considering price, reoccurring costs, administrative costs, and engineering expenses. The Government verified minimum needs through certifying technical and requirements personnel. No additional market research was conducted among alternative brands based on the unique technical requirements outlined. The acquisition will be synopsized on sam.gov.

Subj: BRAND NAME MEMORANDUM TO ACQUIRE SNAP-ON BRAND TOOLKITs

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order, on a brand name basis, to acquire Snap-On brand parts for various Unmanned Systems supported by NSWC PCD. These items will be used to conduct maintenance and repair on the LCAC system. Snap-on Incorporated is an American designer, manufacturer, and marketer of high-end tools and equipment for professional use in the transportation industry, including the automotive, heavy duty, equipment, marine, aviation, and railroad industries. Competition will be limited to authorized resellers of SnapOn Tools products.

3. A description of the supplies or services required to meet the agency’s needs.

The following items are being acquired:

Item Part Number Quantity

Snap On Tool Kit TFPQ-54039-02 2

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

Pursuant to 10 U.S.C. 2304(c) (1), Snap-On is the only brand of equipment that will meet the Government’s needs for the following reasons. S na p - On e q ui p m e nt are required due to the brand’s ability to be compatible with the existing U.S. Unmanned Systems arts and equipment. Snap-on Tools are the only tools capable of meeting the maintenance, repair, and overhaul (MRO) needs of Unmanned Systems (including Unmanned Aerial Vehicles (UAVs), Unmanned Ground Vehicles (UGVs), and Unmanned Undersea Vehicles (UUVs)). Snap-On is the only brand of equipment that has been tested and qualified that meets the dimensions, configurations, interface dimensions, receptacles mates, and air leakage requirements. These critical components are designated as essential spare logistics required to sustain the Unmanned Systems. Without these spares, any component failure would directly impede crucial repair and maintenance operations, rendering the craft Non- Mission Capable. This will halt the vital development process, significantly delaying the program and the fielding of this asset. Use of alternative parts would be more costly as it would require additional tools and labor to fit the measurement needed. Snap-On already provides parts with precise measurements needed for this project. Additionally, use of alternate equipment may introduce new or changing existing parameters that could damage or effect the proper operation of the Unmanned Systems. Additionally, as autonomous and robotic platforms transition from experimental projects to mission-critical assets in defense, aerospace, and commercial industries, the precision and reliability of the tools used to maintain them have become paramount. Therefore it is imperative that Snap-On brand equipment is acquired. These parts are being acquired to maintain that inventory to ensure the readiness of the LCAC System.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This will be synopsized on the Contract Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any brand other than Snap-On to provide the products.

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

Snap-On brand is the only brand that can meet this requirements.
