About this file

This is a Brand Name Justification document from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), located at 110 Vernon Avenue, Panama City, FL 32407-7001. The document justifies the award of a firm fixed price contract on a brand name basis for the acquisition of an OKUMA – GENOS M560V-5AX Computer Numerical Controlled (CNC) machining tool system (Part #M6670094) and seven associated components, including a mist collector prep kit, conveyor system, tool setter, RF system, circuit breaker kit, pump mount kit with duct and mist port, and a 10 MB program cap. The acquisition will be conducted using simplified acquisition procedures, and the Contracting Officer has determined that this purchase represents the best value and lowest overall cost alternative when considering price, recurring costs, administrative costs, and engineering and redesign costs.

The justification rationale centers on operational compatibility and risk mitigation. NSWC PCD's supporting contractor uses identical Okuma equipment at their manufacturing locations, enabling seamless transfer of CNC programs and drawings without requiring modification. The NSWC PCD shops also utilize this same equipment, making the transfer of critical work straightforward. The document states that selecting an alternative brand would necessitate part design and program modifications, introducing unacceptable risk and delay to rapid development efforts and requiring increased training. No market research was conducted among schedule holders, as the Okuma-GENOS was determined to be the only brand capable of meeting the Government's specific operational and technical requirements.

Subj: BRAND NAME JUSTIFICATION FOR AN OKUMA - GENOS M560V-5AX

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”

This is a brand name justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.

2. Nature and/or description of the action being approved.

This action will award a firm fixed price contract to authorized sellers of the item in section 3 of this document, on a brand name basis.

3. A description of the supplies or services required to meet the agency’s needs.

The purchase is to acquire the OKUMA - GENOS M560V-5AX system with the following:

This acquisition will be conducted using simplified acquisition procedures. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

The Naval Surface Warfare Center Panama City Division (NSWC PCD) currently has a requirement for the item listed in Paragraph 3. The requiring project partners heavily with Contractor support who have expertise and training on the equipment listed in Paragraph 3. The equipment listed in Paragraph 3 is the same equipment that the supporting Contractor is using at their manufacturing locations, making drawings easier to transport and draft. By purchasing the same machine, the Government is able to ensure that the CNC programs will be able to be loaded without requiring modification.

Additionally, the NSWC PCD “Shops” use this equipment and transferring critical work to be conducted there would be seamless. If another brand were to be selected, the part design/program might have to be modified, introducing unacceptable risk and delay to the rapid development requirement due to increased training. As such, it is in the Governments best interest to purchase the brand listed in Paragraph 3 of this document.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(a).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, the Okuma- GENOS is the only brand that can meet the Government’s needs.

7. Any other facts supporting the justification:

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the OKUMA – GENOS M560-5AX brand/model is the only brand that can meet the requirement.
