About this file

This is a Brand Name Justification document issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) authorizing single-source acquisition of STIDD brand replacement parts for the Diver Propulsion System.

The Government seeks to acquire five line items totaling 38 units of STIDD brand components: 20 Slide Mount RNAV Mast Clips (Subsafe), 5 DPD Bow Edge Replacement Trim Kits, 2 Sonar Closeout Plate Assemblies, 1 Antenna Mast Mount Assembly (360 Rotation, Subsafe), and 10 Hitch Assembly Kits for Cargo Pods. The acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels but not exceeding the simplified acquisition threshold. STIDD is justified as the sole qualified source because it is the Original Equipment Manufacturer of the diver propulsion device and the only brand of acoustic communications modules demonstrated to meet the technical requirements of USSOCOM PEO-M Combat Diving. The STIDD DPD3 has undergone rigorous testing and is the approved diver propulsion device for USSOCOM military operators. The Contracting Officer has determined that STIDD acquisition represents best value and lowest overall cost, with no significant savings expected through competition. Market research was not conducted as STIDD is the only brand capable of meeting the Government's needs, and alternative brands have not demonstrated proper interface or technical capability for military operator requirements.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).

The Naval Surface Warfare Center Panama City Division has a need for the item listed in Paragraph 3 of this document. STIDD is the Original Equipment Manufacturer (OEM) of the diver propulsion device and the only brand of acoustic communications modules demonstrated to meet the requirements of the sponsoring program office, USSOCOM PEO-M Combat Diving. The STIDD DPD3 is an approved diver propulsion device for use by the USSOCOM military operators and as such, it has undergone rigorous testing to demonstrate it meets the technical capability requirements of its operators. Another brand has not been demonstrated to properly interface and meet the technical requirements of the USSCOM military operators and sponsoring program office. As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to acquire the STIDD brand.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (such as considering price, special features, administrative costs) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, STIDD is the only brand that can meet the Government’s needs.

7. Any other facts supporting the justification.

None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, STIDD is the only brand that can meet this requirement.
