PERFORMACE WORK STATEMENT (PWS)
Proficiency Test Subscription
PART 1
GENERAL INFORMATION
1. GENERAL: This is a non-personnel contract to participate in Proficiency & Interlaboratory Testing (P&IT).
The Government shall not exercise direct supervision or control over any contractor employees. Notwithstanding, contractor shall ensure employees comply with all requirements of this Performance Work Statement (PWS) and contract.
1.1 Description of support: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal support necessary to provide proficiency testing (PT) samples and evaluate results as defined in this PWS. The contractor shall perform to the standards in this contract.
1.2 Background: Puget Sound Naval Shipyard’s Laboratory Department participates in continuous commercial inter-laboratory studies necessary to demonstrate measurement competence and thereby maintain laboratory accreditation currently provided by the NAVSEA Laboratory Quality and Accreditation Office (LQAO), Code 04X6.
1.3 Objectives: To participate in scheduled proficiency tests to demonstrate continued laboratory competence as required for accreditation.
1.4 Scope: Subscription includes: Contractor shipping proficiency test samples to PSNS. PSNS performs testing of samples and reports results for each analyte back to Contractor. Contractor compares sample results to those of other participating laboratories and issues an evaluation report for each reported analyte. Note: the samples do not get shipped back to Contractor.
1.5 Period of Performance: The ordering period for this IDIQ is five (5) years from date of award. To begin on or around 01 December 2022.
1.6 General Information
1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure support performed in accordance with this technical document. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective support. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. In addition, the contractor shall maintain ISO 17043 accreditation for proficiency test samples required by this technical document. Accreditation must be issued by an accreditation body accredited to ISO/IEC 17011 per ILAC MRA signatory. Accredited laboratory conformity assessment bodies (Economy: United States of America) competent with ISO/IEC 17011 include the following providers:
• AIHA Laboratory Accreditation Programs
• A2LA American Association for Laboratory Accreditation
• ANSI National Accreditation Board (ANAB)
• International Accreditation Service (IAS)
• National Voluntary Laboratory Accreditation Program (NVLAP)
• Perry Johnson Laboratory Accreditation (PJL)
1.6.2 Recognized Holidays: Contractor is not required to work on the following federally recognized holidays:

1.6.3 Place of Performance: The work performed under this contract is performed at the contractor’s facility.
1.6.4 Type of Contract: The government anticipates the contract type to be a Commercial, Firm Fixed Price Service, Indefinite Delivery Indefinite Quantity (IDIQ) contract.
1.6.5 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5, if required. The contracting officer, technical point of contact (TPOC), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced.
Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. Meetings may be telephonic.
1.6.6 Technical Point of Contact (TPOC):
The TPOC(s) monitor all technical aspects of the contract and assists in contract administration. The TPOC is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notify both the Contracting Officer and Contractor of any deficiencies; coordinate availability of Government furnished property; and provide site entry of Contractor personnel.
The TPOC(s) are NOT authorized to change any of the terms and conditions of this contract. Only the warranted Contracting Officer is authorized to make modifications/changes to the terms and conditions of this contract.
If the Contractor believes any Government personnel has effectively issued a change resulting in a change in effort and price/cost of the contract, the Contractor shall immediately notify the Contracting Officer.

1.6.7 Key Personnel: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to execution of this contract.
1.6.8 Identification of Contractor Employees: All contractor personnel working in situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression that mailto:jerry.meyers@navy.mil they are Government officials. All contractor personnel on a government installation will be required to obtain and wear badges in the performance of this contract.
1.6.9 Data Rights: The Government has unlimited rights to all documents/material produced under this contract.
All documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

4.1 General: The Contractor shall furnish all supplies, equipment, facilities and incidental services required to perform work under this contract that are not listed under Section 3 of this PWS.

5. SPECIFIC TASKS:
5.1. Required Accreditation: Throughout the life of this contract the contractor shall maintain their ISO 17043 accreditation by an accreditation body accredited to ISO/IEC 17011 per ILAC MRA signatory for all proficiency testing services provided. If at any time throughout the life of this contract, the Contractor believes this accreditation may no longer be active or in jeopardy of becoming no longer active they shall immediately (within 3 days) notify the Contracting Officer in writing.
5.2 Basic support. The contractor shall provide supplies and incidental services for interlaboratory proficiency testing.
5.3 Specific interlaboratory proficiency test program support:
5.3.1 The contractor shall ship proficiency test samples directly to the Code 134 Laboratory Division. Samples should be received by the laboratory with adequate time to complete the required analysis prior to result submission deadline (30 days, minimum).
5.3.2 The contractor will make available an annual sample shipment schedule by the beginning of each year. For testing which includes more than one cycle per year, cycles should normally be spaced evenly throughout the year.
5.3.3 The contractor shall maintain a method for efficient and secure electronic laboratory result submittal.
5.3.4 The contractor will evaluate Code 134 performance against the results received from other participating laboratories.
5.3.5 The contractor will distribute an interlaboratory proficiency test evaluation report to Code 134 Laboratory Division. The report shall include relevant statistical information to compare performance against the study population, meeting the requirements of ISO 17043. Minimum report information should include Code 134’s result, the population mean, population standard deviation, and indication of results which fall outside study acceptance limits. Evaluation reports should be distributed electronically within 30 days following result submission deadline.

5.3.7 The contractor shall provide at least the minimum number of cycles per year for proficiency tests as shown in section 5.3.6. The contractor proficiency test program may include additional cycles per year, up to a maximum of 4 cycles per year for a given test.

Performance Requirements Summary
The contractor requirements summarize the performance objectives that relate directly to mission essential items.
The performance threshold briefly describes the minimum acceptable levels of support required for each requirement. These thresholds are critical to mission success.
