About this file
This document is a Justification and Approval (J&A) Notice for a sole-source laboratory testing contract issued by the Department of Veterans Affairs (VA) Hershel Woody Williams VA Medical Center. The VA is awarding a one-year contract valued at $750,000 to Laboratory Corporation of America (Lab Corp) for reference laboratory testing services, including specimen preparation, storage, transportation, processing, analysis, reporting, and consultation. The contract will cover services until a new VISN (Veterans Integrated Service Network) contract is awarded, and leverages Lab Corp's existing Federal Supply Schedule (FSS) contract.
The sole-source justification emphasizes Lab Corp's unique qualifications, including their highly trained on-site specimen processors, expertise in laboratory testing, established data interface system for electronic health records, and proven track record of providing services to the VA Medical Center for over 10 years. The contract is set to commence on October 1, 2025, with Lab Corp located in Burlington, NC. The VA determined the pricing to be fair and reasonable based on the FSS schedule rates, and no other sources were sought for this acquisition.

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy AgencyRequirementsper41USC§3304(a)(1) as implemented by FAR6.302-1;
() (2) Unusual and Compelling Urgency per 41USC§3304(a)(2) as implemented by FAR6.302-2;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Lab Corp provides a highly qualified technically trained on-site specimen processor with extensive knowledge of laboratory testing menu capabilities. The on-site specimen processor also has an expert knowledge of preparing, storing, and packaging all reference laboratory specimens. The specimen processors are considered the “superusers” of the data interface system for electronically sending results directly to the patient’s electronic health record. Theyenterpatientinformationintothedatainterfaceandensuretestresultsaresenttothe electronic health record. Specimen processors have established effective and efficient laboratory workflows within the laboratory. These workflows have improved continuity of care, decrease specimen turnaround time, and improved patient care.
Lab Corp has an established data interface system for electronically sending results directly to the patient’s electronic health record. Establishing another data interface system will take a considerably amount of time and would cause substantial patient care delays.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
No other sources were sought.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
Reference Laboratory Testing is offered on an FSS schedule at fixed prices. FSS has already determined the prices of testing. Therefore, VISN 5 is not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d). By placing an order against a schedule contract using the procedures in 8.405, VISN 5 has concluded that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market research was conducted, and Lab Corp can provide the service and has an existing FSS contract. They have also been providing this service to the VAMC for 10 years plus. NCO5 is currently working on a new long term VISN contract for Reference LaboratoryTesting.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
The current vendor, Lab Corp has an existing FSS contract. A one-year contract is being requested against the existing FSS contract.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
None.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies orservices required:
A one-year sole source contract is being sought until the long term VISN contract is awarded. There are no actions or barriers identified.
12. Requirements Certification:I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
