About this file

This document is a Limited-Sources Justification pursuant to FAR 8.405-6(c) for the Department of Homeland Security, United States Coast Guard (USCG) to enter into an order or blanket purchase agreement with OWT Global, LLC (OWT) for Field Support Engineer (FSE) services to support the C-Shield/NINJA Counter-Unmanned Aircraft Systems (CUAS) deployed in the USCG Patrol Forces Southwest Asia (PATFORSWA) area of responsibility.

OWT is the only vendor authorized and trained by Black River Systems to service and maintain the C-Shield/NINJA systems. The estimated total value of the order is $747,000 for a 1-year base period beginning September 25, 2024. The Contracting Officer has determined that issuing the order to OWT represents the best value, as they have the required expertise and there are no other scheduled vendors capable of providing the necessary support and maintenance services.

Limited-Sources Justification

Pursuant to the Multiple Award Schedule Program (as authorized by 40 U.S.C. § 501), this justification is prepared in accordance with the requirements of Federal Acquisition Regulation (FAR) 8.405-6(c) for the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3. The circumstance justifying restriction is FAR 8.405- 6(a)(1)(i)(B) through the following facts and rationale:

(1) Agency and Contracting Activity.

The Department of Homeland Security, United States Coast Guard (USCG), Office of Contract Operations (CG-912) proposes to enter into an order or blanket purchase agreement on the basis of a limited-sources justification.

(2) Nature and/or description of the action being approved.

(a) Nature of action: USCG intends to limit competition to OWT Global, LLC.

(OWT)

(b) Name and address of the contractor: OWT Global, LLC, 3710 Corporex Park, Suite 320, Tampa, FL 33619-1160

(c) Contract type: Firm-Fixed-Price

(d) Estimated total value (including options): Provide breakdown as shown below

Period Performance Period Estimated Amount

Base Period 25 September 2024 – 24 September 2025 $747,000.00 Total $747,000.00

(e) Type of funding: Operations and support funds

(f) Year of funding: Fiscal Year 2024

(g) Solicitation number: RFQ1724099

(h) Background information about the requirement: The C-Shield system, which incorporates Negation of Improvised Non-State Joint Aerial Threats (NINJA) Counter-Unmanned Aircraft Systems (CUAS) components is currently deployed in the United States Coast Guard (USCG) Patrol Forces Southwest Asia (PATFORSWA) Aera of Responsibility (AOR). The system requires consistent guidance to the host unit on the C-Shield/NINJA system, implementation and operation, and general upkeep of the system. OWT Global, LLC. (OWT)has been providing FSE subject matter experts (SME) to provide the required services.

(3) Description of Supplies/Services.

The C-SHIELD/NINJA system is currently deployed in the USCG Patrol Forces Southwest Asia (PATFORSWA) area of responsibility (AOR). The NINJA system and small-unmanned-aerial-systems (sUAS) require operation by Field Support Engineers (FSE). FSEs are subject matter experts (SME) and provide guidance to the host unit on the C-Shield/NINJA system, implementation and operation of the system, and general upkeep. FSEs will be responsible for all aspects of NINJA equipment in support of mission objectives.

(4) Identification of the justification and the rationale.

FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

OWT is the only vendor authorized to provide FSEs to service and maintain the C- Shield/NINJA systems. There are no alternate sources for the NINJA products and services on the market. Black River Systems only factory trains FSEs/representatives at OWT on the NINJA systems and they have been the only source trained to provide the services since the product’s inception in 2016.

(5) Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d).

The Contracting Officer has determined that issuing the proposed task order to OWT Global, LLC. represents the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the Government’s needs. The ordering activity has considered the following:

a) Level of effort and the mix of labor proposed to perform the tasks is reasonable. GSA has already determined that the level of effort and the mix of labor proposed to perform the tasks is reasonable.

b) The total price is reasonable. GSA has already negotiated fair and reasonable pricing and a discount will be requested prior to placing an order.

(6) A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research was conducted to identify scheduled holders; however, no vendors available under those vehicles have the training or authorization to perform the support and maintenance that is required on the C-Shield/NINJA system.

(7) Any other facts supporting the justification.

There are no other facts.

(8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made.

Currently, the Government has not identified any vendors who can provide FSE services on the C-Shield/NINJA system other than the Black River factory trained FSEs at OWT. The Government will continue to reach out to Black River to inquire about alternate vendors who they have trained to provide these services thereby increasing competition. Continuing to seek competition will eliminate barriers to competition.

(9) Contracting Officer’s Certification.

I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.

Tina M. Ford Date Contracting Officer

(10) Technical/Requirements Personnel Certification.

I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.

Justin S. Beall Technical Representative/COR
