52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to perform a comparative evaluation of all offers IAW 12.602 Streamlined Evaluation of Offers and l 3.106-2(b):

1. Equipment and Staffing Plan. Provide a written narrative - such as a bullet list or outline – of your plan to perform the work in accordance with the PWS. Include the following subelements within the narrative:

a. What equipment will be used. Include age, size, make and model of equipment. List all safety equipment both installed on machines as well as for personnel. If listing equipment to be purchased upon award, a financial responsibility assessment will be made to ensure offeror can obtain said equipment.

b. Provide detailed personnel information of employees who will perform this contract. Details shall describe if employees performing work under this contract will be employees already on staff, and whether these will be local personnel or bringing in personnel from out of region/state to perform the work. List specifics on training programs for employees. Provide a listing of key personnel that will perform the work including qualifications and experience, along with specific roles that will be performed. Examples include designated Quality Control person, Designated Safety Officer, along with other key personnel. List any examples of previous experience in drafting and implementing Safety Plans and Quality Control plans for similar contracts. The offerors quotation will be evaluated to determine the extent that it demonstrates: a clear understanding of the Performance Work Statement, and addresses all key sub-elements, such as delivering an acceptable approach to completing various work items as described in the bid schedule and PWS specified in various parks/locations as required, subsequently. All Equipment and Staffing identified shall be able to respond within 48 hours of notification to begin work activities.

2. Past Performance and Experience. Provide a written narrative - such as a bullet list or outline - of three examples of similar contracts performed that reflects recent and relevant experience that demonstrates an ability to perform the work in accordance with the PWS. Recent and relevant work is defined as similar work within the past four (4) years. At a minimum, the offeror should provide the following information for each example:

a. Client

b. Description of Work Performed

c. Experience with tree maintenance like activities described in the PWS in a park like atmosphere with uneven terrain including around trees, utilities, and structures.

d. Responsiveness to performing similar work during weekends, nighttime, or other non-normal duty hours.

e. Contract Value

f. Period of Performance

g. Primary Point of Contact for Client

Past Performance Questionnaire forms provided in the solicitation shall be completed by the offeror's previous clients and submitted with the offer. Recent and relevant work is defined as similar work within the past four (4) years.

The offerors quotation will be evaluated to determine the extent that it demonstrates a familiarity with performing services of a scope and price like those to be acquired in this solicitation.

In addition, the Government will query the Contractor Performance Assessment Reporting System (to include ACASS, CCASS, and CPARS) to validate past performance ratings on Department of Defense contracts and any other past performance information the Government deems necessary to evaluate a contractor’s past performance.

Previous history of performance on DoD contracts is not a requirement for consideration of offer. Past Performance Questionnaire forms provided in the solicitation shall be completed by the offeror’s previous client and submitted with the offer. Recent and relevant work is defined as similar work within the past four (4) years. The offerors quotation will be evaluated to determine the extent that it demonstrates satisfactory performance on contracts of similar scope and price. While prior experience is not a mandatory requirement of this solicitation, the contracting officer reserves the right to consider a quote demonstrating recent and relevant experience to be of higher value to the Government than a similar proposal with no recent and relevant past experience

3. Price. The Government will perform a price analysis after completion of technical evaluations. Price analysis will be performed in accordance with FAR 15.404-1, to determine completeness, reasonableness, and understanding of the work. Price will not be rated but will be a factor in making the final best value determination for award.

Basis for Award.

Offers will be evaluated by performing a comparative evaluation in accordance with FAR 13.106-2(b)(3) to determine which response represents the “best” as a whole. Comparative Evaluations is the act of comparing two or more offers or proposal in response to the RFP. Proposals are evaluated by performing a direct comparison of each offer to one another in a uniform manner to determine which offer provides the best benefit to the government. The government has the discretion to accept other than the lowest priced offeror that provides additional benefit and/or lower performance risk.

The combination of all technical (nonprice) evaluation factors are approximately equal to price. As technical ratings and relative advantages and disadvantages become less distinct, differences in price between proposals are of increased importance in determining the most advantageous proposal. Conversely, as differences in price become less distinct, differences in rating and relative advantage and disadvantage between proposals are of increased importance to the determination.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
