About this file

This is an Indian Economic Enterprise Representation Form required by the Indian Health Service (IHS) under the Buy Indian Act authority for federal contract opportunities.

The form serves as a self-certification document that offerors must complete to demonstrate eligibility as an "Indian Economic Enterprise" (IEE) with Indian Ownership under 25 U.S.C. 47 and EHSAR 326.601. The enterprise must maintain eligibility status at three critical junctures: when submitting an offer, at contract award, and throughout the full contract performance period. Offerors must declare whether they do or do not meet the IEE definition and provide the name of the Federally Recognized Tribal Entity, the 51% owner information, business name, UEI number, and authorized signatory certification. Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the successful offeror's eligibility is questioned. Offerors must also maintain registration with the System of Award Management (SAM). The form emphasizes that false or misleading information submitted during the offer phase constitutes a violation under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Contractors must provide immediate written notification to the Contracting Officer if they cease to meet eligibility requirements at any point during the specified periods.
