About this file
This is a Memorandum to the Contract File documenting an approved deviation from the Buy Indian Act for the Indian Health Service (IHS).
The deviation pertains to procurement action PR# IHS1529689 and addresses the requirement under 48 CFR Part 326, Subpart 326.603-3 and IHM 5.5-6 for IHS to provide preference to Indian Economic Enterprises (IEEs) whenever authorized and practicable. Red Lake Hospital requires ongoing service, maintenance agreements, and auto-shipped supplies for a Siemens Rapidpoint 500e blood gas analyzer. All supplies and services are analyzer-specific and proprietary to Siemens, cannot be interchanged with other vendors, and must be completed by Siemens representatives. The deviation is justified because the government already owns this equipment, replacement would require additional expenditure, and the current analyzer is not in need of replacement at this time. The document includes authorization thresholds requiring different approval levels based on contract value, ranging from the Contracting Officer for micro-purchase actions to HHS office leadership for contracts exceeding $68 million. The deviation was authorized prior to issuing the solicitation for simplified or commercial items, with the Contracting Officer determining through market research that there is no reasonable expectation of obtaining competitive offers from two or more IEEs. Contract Specialist Winona K. Kitto-S submitted this certification on July 7, 2026, confirming the accuracy of all supporting documentation and attachments.

Deviations may be issued prior to or after issuing the solicitation. Please check the appropriate box.
Deviation is authorized prior to issuing the solicitation for simplified or commercial items.
Basis: The Contracting Officer determines, after a thorough market survey/research, that there is no reasonable expectation of obtaining offers that will be competitive in terms of market price, quality, and delivery from two or more reasonable IEEs or at least one such enterprise that does not exceed the dollar threshold in FAR 13.003. The Contracting Officer shall not rely solely on the program for this determination.
Deviation is authorized prior to issuing the solicitation for other than simplified or commercial items.
Basis: The Contracting Officer determines, after a thorough research, that there is no reasonable expectation that offers will be received from two or more responsible IEEs at a reasonable and fair market price. The Contracting Officer shall not rely solely on the program for this determination.
Deviation is authorized after issuing the solicitation for simplified or commercial items.
Basis: Only one offer has been received from a responsible IEE and the price is unreasonable, or no offers have been received from a responsible IEE.
Deviation is authorized after issuing the solicitation for other than simplified or commercial items.
IHM 5.5-6 EXHIBIT 1

Facts: Red Lake Hospital is in need of service, a maintenance agreement and auto-shipped supplies for the Siemens Rapidpoint 500e blood gas analyzer. Supplies can only be provided by Siemens as all supplies are analyzer specific and can not be interchanged with another vendor. All service on the analyzer must be completed by a Siemens representative.
This is equipment that is already owned by the government, its service and supplies are proprietary. It would cost the government additional funds to procure another analyzer to replace. The current analyzer is not in need of replacement at this time.
