About this file

This document is a required federal contracting clause template for the "Buy American Certificate" provision, effective October 2022, to be inserted into federal solicitations in accordance with FAR 25.1101(a)(2).

The clause establishes certification requirements for offerors regarding the domestic or foreign origin of end products being supplied. Offerors must certify that each end product is a domestic end product, except those specifically listed as foreign end products, and that each domestic end product contains a critical component. Foreign end products manufactured in the United States that do not qualify as domestic must be identified, along with an indication of whether they exceed 55% domestic content (except for Commercially Available Off-The-Shelf items). The clause requires offerors to separately list the line item numbers of domestic end products containing critical components, with reference to FAR 25.105 for definitions. Paragraph (b) provides a table for listing foreign end products with their country of origin and domestic content threshold status. Paragraph (c) requires listing line item numbers of domestic end products with critical components. The Government will evaluate offers in accordance with Part 25 of the Federal Acquisition Regulation. Key terms including "COTS item," "critical component," "domestic end product," "end product," and "foreign end product" are defined in the companion "Buy American-Supplies" clause within the same solicitation.
