About this file

This is a clarification document issued by the Maine Department of Education regarding competitive bidding requirements for school bus purchases by School Administrative Units (SAUs). The document clarifies that to be eligible for state subsidy, SAUs must procure school buses through one of two methods: purchasing from a bidder selected through the State school bus Request for Qualifications (RFQ) process, or conducting their own local competitive bidding process and providing documentation of that process to the Department. The clarification specifies that all interested and qualified bidders must be permitted to submit bids in response to both the State RFQ and any local competitive bidding processes conducted by individual SAUs.

Bus purchases from vendors who did not participate in either the State or local competitive bidding process are ineligible for state subsidy. This clarification addresses Department of Education Rule Chapter 81, Section 081.1(C), which mandates that competitive bidding be conducted for all school bus purchases. The policy ensures transparency, fair competition, and accountability in school bus procurement while maintaining state subsidy eligibility requirements for Maine's SAUs.

CLARIFICATION REGARDING SCHOOL BUS PURCHASES AND COMPETITIVE BIDDING

Last year, questions arose regarding the requirement in Department of Education Rule Chapter 81, Section 081.1(C) that “[c]ompetitive bidding must be accomplished for all school bus purchases.” To clarify, in order for a school bus purchase to be eligible for State subsidy, the SAU must either (1) purchase the bus from the bidder selected through the State school bus RFQ or (2) provide evidence to the Department that the purchase was the result of a competitive bidding process conducted by the SAU. All interested, qualified bidders must be allowed to submit bids in response to the State’s RFQ as well as in any local competitive bidding process. Bus purchases from bidders who did not participate in either the State or local competitive bidding process will not be eligible for State subsidy.
