About this file

This budget email from the Bay County Budget Division documents the renewal process for Contract 22-66, an Arbitrage Rebate and Opinion Service contract with Arbitrage Compliance Specialists, Inc., which is expiring on September 30, 2026, with no remaining renewal periods available. The County is soliciting proposals for a new arbitrage rebate calculation and opinion service contract (26-47) to ensure continuity of services for tax-exempt debt subject to the Tax Reform Act of 1986 and related IRS regulations. The scope of services includes computing yields on the County's debt, calculating rebate amounts, yield reduction payments, and spend-down penalty payments, as well as providing legal opinions on such computations. Proposals are due July 23, 2026, with a 90-day turnaround time anticipated for contract award to allow the new contract to be in place before the current contract expires. The Bay County Board of County Commissioners will serve as the decision-making body for contract award.

The email indicates that the Budget Office and Risk Management have already approved the request for solicitation, and the updated scope of services has been revised from the previous contract with modifications to outstanding debt issues documented on pages 1 and 6 of the specification document. The incumbent contractor, Arbitrage Compliance Specialists, Inc., held the previous contract (22-66) under the same service category. Proposers must be qualified to perform arbitrage analysis and rebate calculations under federal tax law and to render legal opinions on their work product, indicating specialized expertise requirements for this procurement.

Good morning!

Here is our request form and an updated scope of services. The scoring need not change, but the list of outstanding debt issues on page 1 and page 6 have been updated.

I have already had Risk as well as the Budget Office sign off on the request for solicitation. 😊

Thank you, Suzie
