CLASS JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Systems Command (NAVAIR) Headquarters

2. Description of the Action Being Approved.

This Class Justification and Approval (CJ&A) authorizes and approves the issuance of Cost-Plus-Fixed Fee (CPFF) and Firm-Fixed-Price (FFP) contract actions to BSC Systems, Incorporated (BSC) for engineering services to the United States Navy (USN) and Foreign Military Sales (FMS) customers of the Harpoon Weapon System (HWS) to support the Harpoon Command Launch System (CLS) on existing domestic and foreign partner aircraft, and ship and submarine weapon systems. The total dollar estimate for this acquisition covered by this CJ&A is $4,679,000.00. Authority to act under this CJ&A expires on March 31, 2024.

3. Description of Supplies/Services.

This CJ&A covers support, which will include program management, engineering, configuration management, system software safety and security certification and accreditation, independent witness of formal developer testing, metric development and maintenance, maintenance of independent PC-based model of Harpoon missile routing algorithm, and maintenance of software traceability tools for the Harpoon CLS as well as modifications to the Harpoon CLS. This support effort also includes developing test procedures for ensuring Aegis modernization baseline compliance with the Aegis-Harpoon interface specification, supporting preparation and coordination of requirement specifications for improved obstructions over water for use by USN and FMS Harpoon customers, performing the Independent Validation and Verification (IV&V), providing Independent Safety Assessment Report of Harpoon Command Launch System upgrades, supporting re-accreditation of core Block II Precise Positioning Service (PPS) Harpoon Ship Command-Launch Control Set (HSCLCS) for both Coastal Target Suppression (CTS) and non-CTS international customers, and provide Independent Safety Assessment Reports of the Harpoon Weapon System Training Systems.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

BSC is the only source who can perform the requirement described in this CJ&A. BSC is uniquely qualified to support PMA-201 for USN and FMS Harpoon programs because BSC has extensive unique and specialized corporate experience in the IV&V and Software Safety Analysis of the Harpoon launch control system software as well as deployed Harpoon Training systems. This specialized experience for Harpoon Command Launch Systems includes: 1) currently fielded versions of Harpoon Ship Command-Launch Control Set (HSCLCS) V6/7, V8/9, V9/10 and V11/12. 2) Advanced Harpoon Weapon Control System (AHWCS) Vers 1 and 2., and 3) Encapsulated Harpoon Launch Control System (EHCLS) Ver II and III.

Specialized experience with the Harpoon Training systems includes: 1) HSCLCS Embedded Trainer (HET), 2) Harpoon Interactive Tactical Training System (HITTS), and 3) Harpoon Engagement Training Aid (HETA). AEGIS is modernizing all of the Harpoon carrying cruisers and destroyers under two large programs: Advanced Capability Build (ACB) 08 and ACB 12. These modernization programs require the Harpoon Weapon System to perform regression testing to ensure ACB changes have not negatively impacted weapon employment. BSC has the corporate knowledge and experience to develop detailed test procedures utilized to fully exercise all Harpoon pre-launch functions and ensure that the initialization parameters provide expected results. BSC also monitors and analyzes the AEGIS Computer Program Change Request (CPCR) database to determine potential impact to the Harpoon Weapon System. Often, HWS impact is not obvious from the CPCR title or meta data. It requires knowledge of the USN version of HSCLCS, the various interfaces to AEGIS, and the changes to that interface in each ACB build. BSC has, through their own funding, paid to have an interface program developed to extract CPCR data from the proprietary AEGIS database for import to Excel. Today, there are over 300 HWS-related CPCRs in the BSC database. BSC’s detailed knowledge of the HWS has also been utilized to provide expertise in Software Safety Analysis and Information Assurance. BSC maintains a technical library with over 1,000 items going back to 1983 that is in many cases the only known location for specific technical documentation. BSC personnel have provided decades of direct support to the Harpoon program and no other company is known to possess the knowledge and data products provided by BSC. Award to another source would result in unacceptable delays in fulfilling the agency's requirements, to include the time required to develop a new technical data package, qualify a new source based on that technical data package, and the time requirement for a new company to fully understand the weapon system in order to provide the needed support. These efforts have historically taken anywhere from 10 to 12 years; this timeline would not support the delivery requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Class Waiver of DFARS PGI 206.302-1 Request for Information/Sources Sought Requirement was approved by AIR-2.4, Ser 24-19-005. The Program Executive Officer, Unmanned Aviation and Strike Weapons, (PEO (U&W)), maintains a constant survey of the missile industry and can identify no other source capable of satisfying the Government’s requirement. The notice required by FAR 5.201(b) was posted 30 May 2019 to Federal Business Opportunities stating the Navy’s intention to award a sole source contract. To date, no responses have been received. Any inquiries as a result of this notice will be given full consideration prior to award.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR Subpart 15.404-1, the Procuring Contracting Officer (PCO) will determine that the procured requirements authorized under this CJ&A are from a responsible source at a fair and reasonable price. The Contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. The negotiated actions will be conducted in accordance with FAR Subpart 15.4 by the PCO, with support, as needed, from Defense Contract Management Agency (DCMA) and Defense Contract Audit Agency (DCAA) personnel to ensure that fair and reasonable prices are established. The Contracting Officer’s determination of fair and reasonable price will be based upon information received from historical data, field audits, independent technical evaluations and thorough cost/price analysis.

8. Actions to Remove Barriers to Future Competition.

NAVAIR performed market research as required by FAR Part 10 and if another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. NAVAIR will include required and appropriate technical data and computer software clauses and enforce these clauses to ensure that it receives the license rights that the Government is due. Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior CJ&A was provided to the approval authority to review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
