The Government determined that the incumbent contractor's specialized expertise, established processes, and proven reliability are essential to sustaining operational effectiveness, and that any lapse in contract coverage would significantly impair vessel loading and unloading and delay critical supplies and equipment movement. The current contract was awarded using FAR 13, Simplified Acquisition Procedures, Subpart 13.5 and FAR Part 12, Acquisition of Commercial Items, with services provided under existing firm fixed prices in the Schedule of Rates. No market research was conducted due to the unusual and compelling urgency. The Government anticipates conducting a recompete for the follow-on acquisition using full and open competition.

1. CONTRACTING ACTIVITY.
United States Transportation Command (USTRANSCOM), Directorate of Acquisition, Specialized Transportation and Support Division (TCAQ-R), 508 Scott Drive, Building 1900W, Scott AFB IL 62225-5357.
2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
This action will result in a modification (P00008) to increase the ceiling of the Bremerhaven Germany contract at the Port of Bremerhaven, Germany. The operational tempo at this location has significantly increased. This increase is not a temporary surge but a direct consequence of a strategic shift from a “Port Diversity” approach to a more focused “Port Optimization” strategy.
As a result, the contract ceiling will be increased by $ from $ to $ to cover operations through the existing period of performance which ends 31 October 2027. This represents the second ceiling increase for the contract. The initial increase (P00005) was implemented on 25 November 2024, raising the contract ceiling by $ to a new total of $
3. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS.
The United States (U.S.) Army Transportation Command (ARTRANS), 598th Transportation Brigade requires continued S&RTS support under this contract for stevedoring and longshoring services through the Port of Bremerhaven. The port of Bremerhaven plays an indispensable role in facilitating the deployment and redeployment of major ground forces, including multiple Infantry and Armored Brigade Combat Teams.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.

The statutory authority permitting the use of other than full and open competition is 41 U.S.C.
3304(a)(2), Unusual and Compelling Urgency, as implemented under Federal Acquisition Regulation (FAR) 6.302-2.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF
THE AUTHORITY CITED.
Given the threat of interruption in mission support at Bremerhaven port, the Government recognizes that the incumbent contractor’s specialized expertise, established processes, and proven reliability are essential to sustaining the 598th Transportation Battalion’s operational effectiveness throughout EUCOM. Any lapse in contract coverage would significantly impair vessel loading and unloading, delay the movement of critical supplies and equipment, and undermine military readiness. As initiating a new contract would cause a break in essential services, increasing the current contract ceiling is the only viable solution.
The incumbent’s integration with ongoing operations and capacity to meet increased demands justify invoking 41 U.S.C. 3304(a)(2) and FAR 6.302-2 to preserve uninterrupted, mission-critical logistics support for U.S. Forces in Europe.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICAL.
Competitive offers were not sought specifically for this contract modification. Notice of this action was not posted IAW FAR 5.202(a)(12) as the proposed contract action is by a Defense agency and the proposed contract action will be made and performed outside the United States and its outlying areas, and only a local source was originally solicited.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.
The current contract was awarded using FAR 13, Simplified Acquisition Procedures, Subpart
13.5 and FAR Part 12, Acquisition of Commercial Items. The services will be provided under the current line item in the Schedule of Rates. Therefore, no updates will be made to the contract’s firm fixed prices as a result of this modification.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED.
Due to the unusual and compelling urgency, no additional market research efforts were conducted for this action.
