This preference shall not apply when sufficient quantities of steel rolled in Louisiana are not available.
PRIOR APPROVAL: Bidders desiring to use any materials or products other than those specified, shall submit a request in writing to the Project Designer, no later than seven (7) working days before bid opening date naming the proposed substitution and furnish specifications, test date, samples, or other material necessary to establish the quality of the substitution. Approvals will be given in writing only and will be forwarded to all Bidders via addendum.
The requirement of approval in an addendum of substitute materials of equal quality to those specified shall not preclude the approval of equal materials after receipt of bids. Contractors are cautioned that BREC reserves the right after receipt of bids to disapprove the use of any material not considered to be the equal of the one specified or not having pre-approval.
Contractor’s reliance upon unapproved materials shall be entirely at their own risk.
Contractor is required to submit materials to the Project Designer for approval under the terms outlined above. Failing to comply with the above requirements may result in the rejection of materials.

47:301(8)(c); and La. R.S. 33:1334(D). Furthermore, in order for the Owner to take advantage of this sales tax exemption, and in accordance with La. R.S. 38:2212(S), the Owner will designate Contractor, its subcontractors, and the sub-subcontractors as its agent(s) for the purchase of materials, supplies and equipment to be incorporated into the work or which are purchased solely for use and consumption in the fulfillment of the work under this Agreement. The designation as agent is for the sole and limited purpose of purchasing supplies and equipment for the Project and pursuant to the terms of the Contract Agreement. Some leases may be eligible for tax exemption. Purchases or leases of materials, supplies and equipment which are not incorporated in the Project or which are not otherwise authorized pursuant to the terms of the Contract Agreement are not eligible for the exemption. The parties do not intend that the Contractor, subcontractors or any sub-contractor should be the agent for the Owner for any other purpose.
In order to preserve the Owner's entitlement to tax exemption, the Owner will provide the Contractor with the Louisiana Department of Revenue Designation of Construction Contractor as Agent of a Governmental Entity Sales Tax Exemption Certificate covering purchases by a political subdivision of the State of Louisiana (R-1020). This completed form shall be presented to vendors of supplies, materials and equipment as authority that sales tax is not to be charged.
