About this file
This document is a Non-Competitive Procurement Justification Memorandum for a specialized cooling coil component for the Plasma Arc Waste Destruction System (PAWDS) used on the CVN-78 Class naval vessel. The procurement is for a specific cooling coil (Part Number W6 2602 320000) and installation support baffle (Part Number W6 2602 340001) manufactured exclusively by PyroGenesis Canada Inc., which is the only source capable of producing this component. The justification is based on the unique design requirements of the naval environmental system, with market research confirming no alternative heat exchangers meet the necessary CVN-78 dimensions and specifications.
The procurement is for a single source acquisition with a required delivery date of May 2026 and a 42-week lead time. The component is critical to the PAWDS system, which is the primary waste handling system on the CVN-78 Class. PyroGenesis Inc. has developed this component as part of a specific design package (SCD package 28973), and currently supports one in-service asset and three manufactured for the PMS 378 new construction program. The memorandum cites Federal Acquisition Regulation (FAR) provisions allowing for single-source procurement under specific circumstances, particularly for items with unique manufacturer-specific characteristics.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025
MEMORANDUM FOR FILE
FROM:
CODE: Code 633 TO: Code 02
DATE: 6/16/2025
SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer
3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)
The PAWDS Cyclonic Separator cooling coil condenses off-gases from a plasma waste destruction reaction.
CVN-78 is currently the only in-service asset that uses this technology. The old version of this component (PN W6 2601 320000) degraded over time every 9 months. Code 633 in collaboration with the OEM developed this new design as part of an SCD package 28973. PyroGenesis Canada Inc. designed the newer model (PN W6 2602 320000) as well as the Cyclonic Separator sub-assembly component including the installation support baffle (PN W6 2602 340001) of PAWDS and is the only manufacturer to assemble this part. Required delivery date is by May 2026 with a 42 week lead time.
Manufacturer: PyroGenesis Inc.
Address: 1100 René-Lévesque Boulevard West, Suite 1825, Montréal (Québec), H3B 4N4, Canada Phone: 514-937-0002 ext.441 POC: Elizabeth Del Chiappa, edelchiappa@pyrogenesis.com
III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.
The Plasma Arc Waste Destruction System (PAWDS) is manufactured by PyroGenesis Inc (PCI) as the primary waste handling system on the CVN-78 Class and was procured as Contractor Furnished Equipment by the PMS 378 program office. So far, there is one in-service asset and three manufactured for the PMS 378 new construction program and all are being manufactured by PCI. PCI designed the cyclonic separator sub-assembly component of PAWDS and is the only manufacturer of the cooling coil. Market research was conducted on other heat exchangers but they did not meet the necessary CVN-78 dimensions nor the naval environmental requirements this system must meet.
