About this file

This memorandum provides justification for a sole source procurement of 3D printers and filament from Lulzbot and IC3D, respectively. The Naval Surface Warfare Center, Carderock Division requires quantities of Lulzbot TAZ Workhorse 3D printers, spare parts, and IC3D PETG filament to support the Marine Corps Expeditionary Fabrication program of record through an indefinite delivery indefinite quantity contract. These particular brand name products are needed to match items already tested and certified for use in existing systems. Using alternative equipment would require retesting and delay fielding by at least one year. The solicitation for this blanket purchase agreement is identified as N0016723Q0206 and is issued by the Department of the Navy Naval Sea Systems Command for procuring 3D printers.

MEMORANDUM FOR FILE

FROM:

CODE: 618

TO: Code 02 SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6(b)(1) states Brand name specifications shall not be used unless the particular brand name, market research similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the

3. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

4. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

The LulzBot and IC3D brand name commercial items are required in order to replicate first article units for testing at NSWC Crane as this brand name component was already tested and proven in the existing systems. The items previously procured are being used to obtain testing certification, cybersecurity certification, and fielding approval from USMC Program Manager Supply & Maintenance Systems.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

Fargo Additive Manufacturing is the OEM for Lulzbot TAZ Workhorse 3D printers and spare parts and sells them directly as well as through authorized third-party resellers and distributors. IC3D is the OEM for ICD3 PETG Filaments and sells them directly as well as through authorized third-party resellers and distributors.

3. Other Reasons:

LulzBot is an industry standard at large and within the Navy. The risk to mission impact in not obtaining the LulzBot TAZ brand name of 3D printers is that retesting and recertification will need to be done to find a new suitable 3D printer, which would delay the fielding schedule by at least a year. The XFAB program of record is already two years into its fielding schedule and will continue fielding through FY26.

IC3D is also an industry standard at large. Their product has a high reputation for high quality plastic filament.

The risk to mission impact in not obtaining the IC3D brand name of PETG filament is that quality will be sacrificed and there is a risk that non-IC3D brand name PETG will be unusable in XFAB. If the non-IC3D brand name PETG is unusable, then XFAB cannot be used to complete its mission.

B. SOLE SOURCE (select all that apply)

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. Other Reasons:
