FEDERAL BUREAU OF INVESTIGATION

FINANCE DIVISION I PROCUREMENT SECTION

JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND

OPEN COMPETITION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (l)f

Requisition Number: DJF-21-0700-PR-0001890

Date: 6/14/21

Estimated Contract Dollar Value: -

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Operational Projects Unit (OPU), has prepared this justification for other than full and open competition for a Phase One

Rainbow System on behalf of OPU, Laboratory Division.

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

The requirement is to purchase a Phase One Rainbow System 1 OOMP - Multiband & Narrowband Version for a firm, fixed-price contract from a sole-source. A Multispectral Imaging (MSI) device is required to replace our current camera that is out of life cycle and no longer supported. Specifically, the Phase One, Rainbow is requested.

3. A description of the supplies or services required to meet the agency's needs.

The requirement is to provide a Multi Spectral Imaging Solution (MSI) camera system to our Forensic Studio Photographer's at a cost of $X.XX. The Phase One Rainbow MSI will allow our Scientific and Technical Photographers to capture multi stacks of evidentiary photos, which is critical to the mission of the Forensic Studio Services Program (FSSP).

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 10 USC 2304(c)(l) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entiteled, "Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements." - Application for Brand Name.

The requested camera is vital to ensuring the OPU's continued support of all applicable programs within the Unit and the FBI as a whole, and collaborative efforts with outside agencies and law enforcement entities.

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The requested products are critical components in OPU's Forensic Studio the continued ability to capture and photograph evidentiary prints such as fingerprints, tire treads, shoe prints, etc., and share these images with said partners. Purchasing of alternative products may result in negative impacts to the OPU's mission such as not being able to capture the necessary prints under the right lighting or UV wavelengths and/or delays in the processing of time-sensitive data for use by partnering agencies/law enforcement entities.

OPU has determined that the requested Phase One Rainbow Camera System is the only suitable option to ensure continuity of operations. The Phase One Rainbow System will allow for non-invasive and non-destructive contactless analysis, utilize specialized software able to capture full arrays of UV wavelengths and colors and the will digitally and automatically "flatten" exposure normalization into a "Perfect Stack" of the chosen lighting method.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

Competition is anticipated for this acquisition in the form of a brand name only request for quote, to be published on sam.gov, and set-aside for small businesses. In accordance with FAR5.301, this action will be synopsized on sam.gov and the brand name justification will be made publicly available.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Di~ons, a certified Phase One reseller, quoted the Rainbow MSI System at a fixed price of __ .

8. A description of the market research conducted and the results.

OPU conducted both phone liaison and internet-based research to find an appropriate MSI system. From this research, the OPU developed a set of minimum requirements. The minimum requirements that the computer tablets must meet are as follows:

1. Flexible and Mobile Capturing Solutions with iXG 1.00MPWide Spectrum camera system, filter wheel, and flexible lighting options of Multiband DedoLight for visual analysis (CHARISMA method) and Narrowband EurekaLight for statistical analysis.

2. Fully automated high-resolution capture workflow, including all relevant calibration stages and the full capture Stack.

3. One button repeatable of normalized images according to the chosen lighting method (Multiband or Narrowband).

4. Image quality throughout the spectrum, from UV (365 nm), through visible, into IR (ca. 1050 nm), with:

• iXG Wide Spectrum camera, 100Mpixel, high dynamic range CMOS-sensor

• 72mm and 120mm iXG lens line with extension tubes

• One million guaranteed actuations with Phase One Reliance shutter, and option for infinite Electronic Shutter actuations

5. Responsive Live View for fast and accurate positioning of the subject-matter

These efforts resulted in findings that led the OPU to determine that the Phase One Rainbow System is the only suitable option to ensure continuity of operations.

9. Any other facts supporting the use of other than full and open competition.

OPU has worked with Phase One products in the past and has found them to be of the highest quality. Phase One is one of the leading manufacturers of medium and large format camera systems. It is highly recommended by the professional photographers in the industry and the preferred manufacturer for this requisition.

10. A listing of any sources that expressed a written interest in the acquisition.

Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

The OPU will continue to research market conditions, in an effort to determine whether alternative products and/or suppliers might be able to fulfill future requirements. Research will be conducted through methods such as speaking with other government agencies about their similar procurements, attending trade shows/conferences, requesting information from various different vendors, product tests/evaluations, etc.
