About this file

This Memorandum for Record documents a brand name justification for purchasing two OsmoPro Max Osmometers for the WBAMC Clinical Laboratory, with a total value over $25,000. The medical equipment, manufactured by Advance Instruments, is a specialized Osmometry Analyzer used to measure solution concentrations through freezing-point measurement, replacing an existing older model. The procurement is a 100% Small Business set-aside and will be solicited through SAM.gov, with a 60-day delivery timeline from Authority to Operate (ATO) approval.

Market research confirmed the OsmoPro Max is not available through Federal Supply Schedule or Veterans Affairs schedule holders, and is only available on the open market. The justification highlights the instrument's superior features compared to alternative options, including continuous sample loading, automated liquid handling, integrated barcode scanners, quality control capabilities, and Laboratory Information System (LIS) compatibility. The procurement is critical to maintaining the clinical laboratory's diagnostic capabilities, particularly for tests related to hydrolytic balance regulation, renal function, and small-molecule poisonings.

3. Description of Services or Supplies: The OsmoPRO Max (manufactured by Advance Instruments) is an Osmometry Analyzer used in the clinical laboratory to measure the concentration of solutions by means of freezing-point measurement. This instrument offers the same testing capabilities of our current instrument (Model A2O) but improves in turnaround times of testing a smaller footprint, and a peer-to-peer QC review program that will increase the accuracy of the results provided to our clinicians. It also provides automated liquid handling, continuous sample loading, a self-cleaning fluid management system, touch screen operation, integrated barcode scanners, built-in quality control features, Ethernet and USB connectivity, and an integrated data management system. The estimated cost of the purchase will be This will include continued service on current Model A2o-19071004C until delivery of requested equipment, Regent, installation and training to our clinical staff.

4. Authority: Brand Name

XX FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

A. This brand name purchase of the OsmoPro MAX is the only reasonable brand for the WBAMC Clinical Laboratory needs. A contract comparison worksheet was conducted between the OsmoPro MAX by Advance Instruments and the 2430 Multi- OSMETTE Auto- Sampling Turntable Osmometer by Precision Systems Inc., both American manufacturers. The OsmoPro MAX can provide continuous load samples in their primary tubes to minimize workflow interruptions and improve turnaround times, Onboard video instruction guides users through simple cleaning, maintenance, and calibration workflows, Peer Group Program to monitor QC trends and quickly spot shifts in instrument performance, capability to interface with the Laboratory Information System (LIS) through the installations network. The 2430 Multi-OSMETTE has none of the mentioned features that the OsmoPRO MAX provides which are requirements as per our salient characteristics, specifically the ability to have interface with our LIS which is key to our Automation Process. The LIS is how the Laboratory instruments communicate to the network (in our case its GENESIS) to transfer accurate results to our providers electronically. it minimizes the need for staff input, thereby reducing the possibility of erroneous results.

B. This instrument is an upgraded version of our current Analyzer the A2O Model.

Advance Instruments has agreed to provide continued service to our current analyzer (has gone past life expectancy) until the new one is acquired. This will enable the WBAMC Clinical Laboratory to continue providing un-interrupted Care to our patient population.

C. Not approving the instruments for purchase will eventually diminish the clinical capabilities of the clinical laboratory, depriving our providers from a test that can be used for the differential diagnosis of disorders related to hydrolytic balance regulation, renal function, and small-molecule poisonings.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, XX apply and will be followed, or do not apply due to an exception at 5.202 .

Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)

Action is NOT a brand name restriction and is under $250K, no posting required Action is a brand name restriction, under $25K, no posting required XX Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.

Action is a brand name restriction over $25K but will not be posted due to exception:

FAR 6.305(f) FAR 8.405-6(b)(3)(iii)(A) FAR 8.405-6(b)(3)(iii)(B) FAR 8.405-6(b)(3)(iii)(C) FAR 16.505(a)(4)(iii(C)

7. Market Research: Market research was completed in accordance with applicable FAR 10.002(b) (2) procedures. The requirement is for two OsmoPro Max Osmometers (Freezing Point Analyzers) used in the clinical laboratory to measure the concentration of solutions by means of freezing- point measurement.

Market Research was conducted through GSA Advantage and Open Market sources in April 2025. The OsmoPro MAX is not available through Federal Supply Schedule (FSS)/Veterans Affairs (VA) schedule holders in GSA Advantage. The OsmoPro MAX is only available on the open Market

Additionally, a Request for Information (RFI) RFQ1754830 using Multiple Award Schedule MAS 334516, Scientific Management and Solutions – Laboratory Equipment was submitted through GSA Advantage, FSS/VA schedule holders, resulting in no vendors providing quotes.
