About this file

This memorandum justifies the use of other than full and open competition for a single-source acquisition of Hyster forklifts for the Military Sealift Command (MSC). The document outlines an urgent requirement for pre-delivery inspections and safety certification of Material Handling Equipment (MHE) assets, to be performed at Building LP-26 Naval Station Norfolk from May 1 to June 30, 2025. The procurement is driven by critical circumstances, including MSC receiving a massive shipment of forklifts with limited storage capacity, urgent need for safety certification of braking systems, and multiple ships reporting MHE discrepancies.

The memorandum cites several justifications for single-source procurement, including critical ship equipment requirements, unusual and compelling urgency, and the need for specialized services. Specifically, the contractor must have experience with MSC four-wheel braking systems on shipboard approved forklifts and be able to demonstrate brake adjustment techniques. The forklifts are essential for daily ship operations, including supply movement, UNREP stations, and ammunition transport. The procurement aims to ensure ships can deploy with a full complement of operational and safety-certified Material Handling Equipment, preventing potential work stoppages and mitigating risks to personnel and government property.

MEMORANDUM

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION UNDER

THE SIMPLIFIED ACQUISITION THRESHOLD

I. BACKGROUND:

1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

1. Provide a description of the item or service required, to include

a) the name of the required source or brand name

Hyster forklifts

b) the required delivery date/period of performance and

1 May 25 – 30 Jun 20025

c) its intended use.

PRE-DELIVERY INSPECTIONS, SAFETY CERTIFICATION OF MSC MATERIAL HANDLING

EQUIPMENT (MHE) ASSETS.

b. If drawings are included, who is identified as “owning” the drawings.

2 Ver 2.0 (01 July 2018)

No drawings are included.

2. EXCLUSIVE LICENSING AGREEMENTS: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is ONLY ONE authorized distributor or technical representative for the OEM.

a. Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.

b. Identify the distributor / authorized technical representative for the item or service.

Provide evidence of the exclusive licensing agreement as an attachment to this document.

(NOTE: If there is more than one distributor / authorized technical representative, then use Part

B – Brand Name.)

3. X OTHER REASON:

a. X CRITICAL SHIP EQUIPMENT: The required item is critical ship equipment, the failure of which poses a hazard to the ship, the crew or the environment.

i. SMS Procedure Number: _7.6-001_ALL

b. STANDARDIZATION / BRAND NAME: Per MSCs standardization initiative, only the specified make/model of the equipment/parts will satisfy the Government’s needs for additional units or replacement items.

i. Identify Make / Model Number(s):

ii. Identify other vessels with this Make / Model:

c. FORM, FIT, AND FUNCTION: Item is direct replacement parts / components for existing equipment and must be compatible in terms of form, fit, and function with existing equipment / configurations.

i. Identify Make / Model of existing equipment:

ii. Describe how the equipment must be compatible with the existing configuration.

d. X OTHER:

Services to MHE shall be performed ashore at Building LP-26 Naval Station Norfolk. The Contractor’s needs to have worked on MSC four-wheel braking systems on shipboard

3 Ver 2.0 (01 July 2018) approved forklifts and be able to demonstrate / train MSC personnel on how to adjust brakes.

This will allow many USNS SHIPS to get underway with a full complement of operational certified MHE.

Material Handling Equipment (MHE – Forklifts) are used daily to move supplies (stores), used at UNREP stations, and Ammunition movements. If MHE is not Safety Certified for shipboard use, the ships overall mission would be at a work stoppage until Safety Certification is completed. Forklifts need to be Safety certified (Brakes/Lift Cylinders/EMI-sparks/Grounding strap ect..) to prevent Serious injured or death to personal and damage to ship/government property

4. X UNUSUAL AND COMPELLING URGENCY: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:

a. Date on which the requirement was identified: 4 April 20205

b. Required delivery date / Period of Performance: _1 May 25 – 30 Jun 25

c. If the difference between a. and b. is more than one week, explain the delay in submitting t he requirement.

Hyster gave no warning massive amount of forklifts were shipped – MHE team was busy trying to figure out location(s) to put all MHE

d. Estimated production lead time:

e. Explanation of why delivery / commencement of services by the date required is needed: (explain the impact to the mission, any special circumstances or conditions, etc.)

MSC ordered replacement forklifts with and appox 400 day lead time, those forklift started showing up in huge lots and now MSC does not have space to store forklits. These forklifts need Pre-delivery inspections and NAVSEA SWO-23-AH-WHM Ammunition and Explosive Safety Cetrtification prior to being delivered to ships. We have been told that more forklifts will ship in coming months (no set date yet). LP-26 has reached max capacity, forklifts cannot be store in outside environment. Our ships forklift are in dire need of repairs and multiple ships are reporting MHE discrepancies
